    I reside at ***************** I started into at least six years ago with my with my landlord, *********************************, I received mail two months ago letting me know that December 1 company Gardner Realty will be controlling the property . I received mail saying that someone would reach out to me to sign a new lease also that the rent was going up and the late fee was going up . I reached out to the company a couple times no one reached back until after December 5 as of today, December 7. I have not signed a new lease and the company is reaching out to get money from me. Previously, I reached out to the landlord, letting him know that I was thinking about moving. He tried to convince me to stay. I said that I may stay, but then I realize that it will be best for me to leave. on December 3 I sent the email to the leasing company and to my landlord letting him know that I will be moving out as of December 31 the leasing company since December 5 has been reaching out trying to get me to pay rent for December and is trying to tell me that if I don’t pay by December 6, I will have to pay $100 late fee as of today, I have still not signed a contract with the leasing company. The last lease I signed was six years ago for $975 a month and a $25 late fee two years ago the landlord text me telling me that the late fee would be going up to $100 Realty did not reach out to me until after the rent was due I was not given the opportunity to talk to anyone from their company nor was, I given the opportunity to sign a lease lease was never emailed to me. A new lease was never given to me in hand, no one talk to me before December about a lease, even now no one is talking to me about signing a form for new lease I’m being sent text messages and emails constantly about sending in money no one has reached out about repairs. No one has reached out about coming out about repairs. I sent an email out letting them know I will be vacating the property on December 31 . I feel like that is fair.

    This is a response to the complaint filed by ********************************

    The management team at Gardner Realty LLC is saddened by this complaint.  We at Gardner Realty LLC strive to provide excellent service.  

    After reading the complaint, we conducted a level of investigation and came away with lessons learned and advice.  

    Typically, when a landlord/tenant author a lease agreement and the base term expires, without extending in writing, the lease continues month to month.  A landlord has a right to hire a third party to lease and/or manage their property(s).  Therefore, any lease agreement in circulating during that time whether fixed term or at will carry over to the property manager to manage.  Gardner Realty LLC sent a letter stating we were the new property manager outlining basic terms and contact for our company.  The letter indicated that we would make contact to sign a new lease.  Our letter does not cover when or within what time frame this will be done.  WE have revised our property manager letters to now define a specific time frame to when WE will contact a tenant to arrange an updated lease signing. (LESSON LEARNED) 

    We are a bit confused regarding the outreach to our office.  Our records show that we received an introduction email from tenant on November 7, 2023, referencing maintenance issues, etc.  The response provided by Gardner Realty LLC was same day and stated that we effectively begin managing the property on December 1, 2023, and requested a list of repairs sent effective that day to aggressively move forward with work orders.  

    In situations when a tenant, landlord, homebuyer or home seller has an issue with our company, we strongly advise the consumer to escalate to a management representative.  The management team would have really liked an opportunity to resolve the issues and bad feelings.  We never want to know anyone walking away from Gardner Realty LLC feeling disgruntled. (ADVICE)
