    I am in the process of getting an apartment lease with the Bower Hill III Apartments, located at **** ***** **** **** *********** ** ****** After submitting the lease application, the property manager contacted me indicating that my application is conditionally approved as I have co-signed a student loan for my friend with a remaining balance of $21K when my credit score is excellent. I was advised to pay a refundable security deposit of half month's rent to secure the apartment in my name. After I did that, the portal for rent payment indicated that I have to pay half month's rent for Risk Mitigation. I contacted the Property Manager for the same and she mentioned that yes, I have to pay that amount, and that is non-refundable. So, I worked with my friend to pay off the student loan. Now, the loan is paid off, my credit score is excellent, and there is no risk, but the Property Manager says that I have to pay that non-refundable Risk Mitigation fee, no matter what. Is it fair to charge a non-refundable fee for risk mitigation when there is no risk? Note, I am going to take the apartment on August 20th, 2022, and have to pay this non-refundable fee. Can you help? Is this not unfair practice? or is this legal? Please advise.

    This is the normal protocol of our company when someone has
    a conditional approval which is computer generated through Am Rent Consumer
    Assistance and Transunion Consumer Assistance.  As a company that complies with fair housing everyone approved
    “conditionally” is required to pay the risk mitigation fee in the amount of
    half of their monthly rent as well as the refundable security deposit.  The person should have applied for an
    apartment after getting the school loan(s) paid off then it may have come back
    as a different decision.  It was the
    person’s choice to accept the apartment under the terms of the agreement.
