My wife was arrested on a bogus probation violation charge. On April 1, 2022. I traveled to this law office to drop off $2750 specifically for A**** Sodomsky to represent my wife at her hearing coming up later in April. Attorneys Sodomsky entered his name in as her lawyer, and didn’t have a chance to really speak to her before her hearing at the end of April, so he continued the hearing, prolonging her stay in jail another month. On the night of the first hearing that he had continued I emailed him and told him he needed to get in touch with her before the next hearing, which was in another month. On the last day before the next hearing in late May. I left a message for the attorney, asking him why he hadn’t spoken to my wife about her case yet and her hearing was the following day. With no specified reason, attorney Sodomsky continued the next hearing at the end of May. He didn’t even show up for the hearing, he just called and continued it with the judge. I called and asked him why he would do that again, and prolong her stay in jail for another month, and he only stated that he needed to speak with her about her case. Finally, he visited my wife in jail, and she stated that he only yelled at her telling her she could get a year in prison and left. We heard not another word from attorney Sadomsky. He wouldn’t answer my calls anymore. I hired another attorney and paid another attorney $3000 to represent her correctly. I am looking for a full refund as this attorney did nothing to help my wife whatsoever. He only prolonged her stay in jail.

    Business Response

    Date: 03/01/2023

    February 22, 2023
    *** *****:
Thank you for your letter of February 9, 2023 and the opportunity to respond to it. The law and rules of court restrict attorneys in responding publicly to some allegations, and allow responses in certain situations as long as the law and rules are followed.
It is of some note that the statement to which you want a response was made by *** ***** and not our client. *** ***** was not privy to everything that occurred in our representation of our client. Attorneys are required to communicate with their clients and prohibited, in some instances, from communicating with individuals other than their client. While I appreciate *** *****'s version of the events regarding our representation of our client, there are some things which are incorrect in his statement. They may be incorrect due to a lack of knowledge, repeating what other people told him or some other reason perhaps not so benign. Our office represented this client to the best of our ability as we have with every client since our office opened more than 32 years ago. Within days of being retained, a great deal of work was done on this client's behalf. While *** ***** may believe that the arrest of this client was "bogus", the District Attorney's Office, the Probation Office and Judge who signed the Arrest Warrant felt otherwise. Nothing is ever done by our office to prolong a client's incarceration. Even the thought of doing so is absurd. The philosophy at our firm, like many competent criminal defense firms is that one minute of incarceration is too long. We have and will always be cognizant of that philosophy as it is not just our reputation that we have to protect; but it is the core value of our justice system. Repeated contact was made with the District Attorney's Office and the Probation Officers involved to attempt to remedy the accused wrong doing which caused this client to be arrested. We appeared in court on two (2) occasions on behalf of this client in an effort to gain her release, however, the Court found the arrest and allegations to be more than "bogus" on each occasion. Rather than return to court for a third and final proceeding wherein our client could have received a harsh sentence, we opted with our client's consent to attempt a negotiated resolution to have our client return home soon. It was at that point, after a great deal of time, effort and energy spent on the case that *** ***** chose retain other counsel.
Every phone call that is received in this office is returned the same day, unless I am out of town or it is received after hours in which case it is returned the next day. To claim that I would not answer telephone calls is ludicrous as I spend hours each evening doing nothing but returning calls. *** ***** called numerous times and spoke with me if I was available, and if not, he received a return call either that day or the next.
Finally, I do not yell at clients and never have. I have been and always am aware of who pays my salary. My clients have always been the most important aspect of my practice. Without the tremendous support of our clients we would not exist, and I am grateful to the many clients over more than three (3) decades who have trusted us in matters of great import to themselves or their loved ones.
    Very truly yours,
    A**** *. Sodomsky
