    On 7/6/23, a contract (copy attached) was executed with JR Lamey Contracting ("Lamey") for $7,000 to remodel a bathroom. The contract required half the amount, or $3,500, as a deposit. A check in that amount was issued on 7/12/23 and deposited by Lamey. The work was to be started around mid-September. September, October, November all came and went and the project was not started. As such, we canceled the project and Lamey promised return of our deposit several times. To date it has not been returned and the contactor is now not returning communications.

    After not being able to get to the said job on time the customer did cancel the job , this was in November. We then had to still work and try to return all materials bought for the job . With the holidays we had a hard time returning items especially the shower door . I never got everything returned until January  the middle of tax season. I had gotten taxes and all the paperwork I needed with all the returns done at the end of February. The business took a great loss that includes having workers. We now are working by ourselves and trying to juggle even being able to sit down and look at emails. The said customers only used a form of contact that was email no call or text it is easier for me to communicate when I see something right away rather than looking through hundreds of emails yes, we owe them money and I would like to be able to come up with a payment arrangement

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    We seek an immediate return of our deposit ($3,500) as that is a sizable sum for us.  We are retired and currently our primary source of income is SSI.  However and unfortunately, we suppose the only way we will get paid is by bringing legal action or agreeing to a payment plan.  We will contact the contractor to discuss a payment plan but our feeling is that there should be a larger, good faith upfront payment.
