I purchased an 8 x 12 custom shed from ************ hardware for $2465.56 on May 20, 2024. On June 6, 2024 the shed was delivered by an employee named ****** from ******* hardware. While at my residence, ****** ripped up my lawn severely with his trailer and truck whiile offloading the shed. He first struck an expensive solar light smashing it and didn't even apologize. I asked him to be careful of my wife's raised metal garden that she just purchased a few weeks prior and he ended up driving into it denting it and knocking it off it's base, rendering it unusable now. It is impossible to repair because it bent the side and it is filled with a large amount of top soil and garden soil and it will not hold the soil in. ****** didn't even apologize after I told him he struck the metal raised garden, which cost $200. My wife asked him to take a different route in our yard but he insisted that he came in this way and that's the way he is leaving. He then got the truck and trailer wedged by my house and severely damaged my lawn ripping it up while spinning tires and ripping up the grass. The grass was dry. Then he said I guess I should put the truck 4 wheel drive after he completely damaged my lawn. . I asked him to send someone to repair my yard and he retrieved a rake from his truck and raked some of the loose dirt for about a minute and said run it over with a garden tractor and it will be fine. This was beyond that and needed a professional landscaper. I called ******* on Friday June 7, 2024 at 10:50AM and spoke with ********* explaining my damage and how it was handled and it needs to be repaired and she said she would have to speak to ****** and get back to me. It is now July 8, 2024 and she nor anyone else at ************ called me back. I am requesting $400 restitution for the cost of all the supplies I needed (grass seed and topsoil and garden soil; multiple bags) plus the raised metal garden.

    Business Response

    Date: 07/25/2024

When a shed purchase is made thru Kuzan's Hardware, the customer is made aware that we will be driving over a lawn.  The receipt specifically states we are delivering the building and crossing your lawn at your request, therefore we do not accept responsibility for property damage.  The customer had every right to tell the driver to come back another day if he felt the ground and grass would be too wet to drive over without damage.

The driver was not aware of the solar light that was smashed, and customer did not state as such when it happened.  ****** did not hear the customer tell him this.

The customer directed the driver to back  in thru the yard, and was guiding the driver around hazards.  He did not know that the metal garden was hit.
