Thank you for submitting your concerns; NCB Management Services, Inc. (NCB) takes concerns like yours very seriously.
NCB purchased the referenced account on April 22, 2022 from ************* & ********* (*************). This account was an internet loan originating on November 15, 2019. You did not ink-sign an agreement to open this account. You applied online and electronically agreed to the terms and conditions for using the account. That agreement made you responsible for paying this debt and gave ************* the right to collect it from you and to credit report the debt as permitted by law. When you failed to pay, ************* sold the debt and transferred its right to collect and credit report to NCB. ************* may transfer its contractual rights to NCB without your permission or signature. You are still bound by your original agreement to pay this debt. The difference is that NCB now owns the right to collect it and credit report the debt. As stated in our initial letter dated April 25, 2022 NCB is your current creditor to whom the debt is owed.
In response to this dispute, we completed an investigation by reviewing the information you provided as well as information and documents provided to us by your original creditor and information from our own system regarding the current status of your account. The documents we have do not substantiate the allegations of your dispute concerning this account. On July 15,2022 NCB mailed debt validation documents to you. The documents included a copy of the application, the terms and conditions of the loan, a financial transaction history of the account and a copy of the bill of sale agreement between NCB and *************. The documents were mailed to the address on this compliant.
In sum, NCB did not violate the FCRA or the FDCPA. NCB had a permissible purpose to credit report your debt, the information we reported was accurate, and we met our obligation to investigate and respond to your disputes as required by law. NCB purchased the referenced account on May 3, 2021 from ****** ***** ********** ******* *** (******). This account was an auto loan originating with ****** on October 11, 2016 for the purchase of a 2016 ****** ******. As a result of the sale, ****** ********* gave NCB information needed to verify the debt is valid and owed and assigned to NCB all of its rights related to the debt, including the right to collect and credit report the debt as permitted by law. As stated in our letter dated May 7, 2021, NCB is now the current creditor to whom the debt is owed.
A review of our records finds this correspondence to be the first direct request for validation we have received regarding this account. On July 18, 2022, NCB mailed you debt validation documents. The documents included a copy of the signed contract, the deficiency notice, a financial transaction history of the account, and a copy of the bill of sale agreement between NCB and Nissan. The documents were mailed to the address on this complaint. NCB has updated our reporting to the credit reporting agencies regarding this account to reflect the status of your dispute. This complain is due to the negative marks made by your company on my credit file. I would be willing to accept this debt if it were mine and upon Validation and Proof of Claim but its not mine and theres no way that you can validate it. So let it be known that I am requesting full validation of this debt. I demand that you take action to this matter because it is causing me a lot of stress lately. The debt at issue is an internet loan originating with ************* & ******** (********) on September 29, 2021. On April 22,2022, ******** sold the debt to NCB. As a result of the sale, ******** gave NCB information needed to verify the debt is valid and owed and assigned to NCB all of its rights related to the debt, including the right to collect and credit report the debt as permitted by law. On April 25, 2022, NCB sent you a letter notifying you that NCB is now the current creditor to whom the debt is owed.
This correspondence is the first direct request for debt validation documents received by NCB. In a separate mailing, NCB will send you debt validation documents which will include the loan application, terms and conditions of the loan, a financial transaction history of the account and a copy of the bill of sale agreement between NCB and ********. We are required to provide sufficient information for you to verify that the debt is owed and we believe we have met that obligation with these documents. The documents will be mailed to the address in your separate correspondence to NCB received on July 20, 2022, namely; ********************* Houston, Texas***********.
Other than these debt validation documents; NCB will honor the request in your referenced correspondence to cease all attempts at contacting you in the future regarding this debt. NCB respectfully disagrees with the allegations in your complaint. The account at issue is an auto- loan originating with ****** ******* *** (******) for the purchase of a 2012 ***** ******. You entered into a contract with ****** that made you responsible for paying this debt and gave ****** the right to collect it from you. When you failed to pay, causing the loan to go into default, ****** sold the debt and transferred its rights to collect and credit report the debt to NCB on October 6, 2021. You are still bound by your original agreement to pay this debt. The difference is that NCB now owns the right to collect it from you. NCB is your current creditor. Our initial letter containing the required disclosures was mailed to you on November 12, 2021.
NCB has investigated and verified account information previously in response to your indirect dispute. While we believe this dispute is duplicative, we conducted another investigation using the information you provided and the information provided by the seller of the account. Our investigation confirmed the information we reported to the credit reporting agencies regarding this account was accurate, complete, and reported in compliance with the **** and ***** * credit reporting standards. In a separate mailing, NCB will provide debt validation documents which will include a copy of the signed contract, the deficiency notice, a financial transaction history of the account, and a copy of the bill of sale agreement between NCB and ******.
