    I retained Gary Lindsey's services to build me a cement patio June 7 of 2022. At that time, I gave him a deposit of 2,045.66.
    He missed the contract deadline without any contact to me. I reached out several times to see when he was going to do the patio. Each time he would say he'd let me know. This was to be completed within 60 days. Finally in the fall of 2022 (120 days later) I requested a refund. He refused to give me a full refund and then told me he would only give me back 50% of my deposit, which actually was less - $920. 00 was refunded.

    I'm requesting my full money refund from this company. He did zero work...no prep work nothing. I've been patient and at first thought I needed to except his partial refund but was referred to your agency for assistance from other consumers who were able to get their full deposit back. Any assistance you could give would be greatly appreciated.

    To whom this may concern,

    We are and have bee experiencing shortages on all materials especially labor or employee help. This is the reason that we could not comply with the allowed timeline on the contract. Our contract CLEARLY states that this customer had CLEARLY signed and agreed to the terms. 

    "Lindsey is not responsible for its inability to start and/or complete the work under this Contract for delays that are the result of inclement weather, labor problems or other unforeseen circumstances or conditions that are outside the reasonable control of Lindsey."

    This customer was refunded the correct amount due to her based on the contract total and contract cancellation terms that she signed. 

    "PENALTY FOR CANCELLATION.
    If the Owner cancels this contract any time after the three (3) day
    recession period described below, Lindsey shall be entitled to retain 15% of
    the total purchase price, from the deposit provided by Owner."
