A&S was contacted around mid February regarding some chimney repair on my house. They performed a site visit to inspect my house. I was very clear with the expectations and that the chimney needed repair and we needed to drop a liner to a woodstove. We agreed on a price. They scheduled the work to be done. A&S Asphalt sent me a contract which I signed at the end of February. They cancelled 3 times and rescheduled. Finally they arrived to do the work on 3/28/23, looked around and said they had to go get supplies. They never came back. 2 hours later they texted me and said they cannot do the work and that I should find a local company that works with chimneys. This is confusing given everything stated above. They lied. They strung me along. I would like them to send me a industry professional to complete the work for the agreed upon price.Business Response

I am writing this letter in response to the complaint filed by ***** *******. I had given him a rough estimate over the phone for the work that he needed for his chimney. I scheduled going to his residence to better assess the work and hopefully complete the work. It was unfortunate, but due to a death in my family, I had to reschedule. The next time that this was scheduled, it was raining. It is not a good idea to work on a chimney in the rain, so I rescheduled. When the following week came, I was able to assess the work in person at his residence. I immediately noticed and told Mr. ******* that the liner for the chimney is wrong. It should not be aluminum. He insisted that it was fine and that I should do the work. I was not comfortable with doing this and I politely told him that he should have a chimney specialist complete the work. That was the last that I had spoken with Mr. *******. I am asking that this please be stricken from record.Customer Answer

I am rejecting this response because:According to this letter he states that the reason he did not complete this work is because the liner I purchased is wrong. This is false. He never told me this until now.Additionally, the liner is NOT made of aluminum. As per the manufacter website and the documentation included with the liner, it is made of stainless steel. This company is lying trying to get out of a contract. See attached screenshot which shows a picture of the listing which I did send to the contractor prior to his arrival.What did happen was this:
First, prior to his arrival I sent him a link to the liner I intended to purchase. He was aware prior to his arrival. It is not aluminum. It is stainless steel.
Second, upon arrival he inspected the liner and instructions and he said he would need high temperature mortar and showed me in the instructions where that was needed. He informed me due to this extra cost my cost *** change. I accepted that and agreed. He left to 'go get supplies.' But prior to his leaving he looked me in the eye and said, "We can do this, it just might cost a bit more."
Third, his final message to me state, "we don't feel comfortable doing the job" no explanation was given as to why he suddenly became uncomfortable.
Bottom line, I made him aware what he would be doing prior to his arrival. He never once stated my liner was improper. My liner is not improper, it is not aluminum. It is certified and it is designed for this application.
This complaint is valid as this contractor is acting in an unprofessional manner. He is lying.Business Response

I do understand that ****************** is upset. That was never my intention. However, there was never any money given for the work. Upon looking at the work needed in person, I did not feel comfortable completing it. I believe that is my right to not complete any work that I am not comfortable completing. I am rejecting this response because:
This contractor is lying. Even in this exchange he has claimed multiple reasons why he refused to perform this work which I have shown were false reasons. This contractor sent a contract, agreed on a price, showed up, left and refused to return to complete the work. Why he did this has not been explained. Even now, he could make this right by sending an expert to complete the work as contracted.

** October of 2022 I hired contractor to do work at my home.He built a retainer wall,put a ****** in downs bathroom,put new floor in downstairs bathroom and painted the interior of our home.Was to Replace three interior doors.The prep work was not done properly on the walls,the wrong paint was used on our walls , door's and trim and now there are areas that are cracking and peeling.The contractor wanted is to pay for the walls to be redone and we refused to pay for the contractor's mistakes.Our walls have dark areas in *********.They used a paint sprayer in our basement and ruined our drop ceiling tiles and because walls were not prepared for paint correctly you can see all of the imperfections in the walls along with paint that ran down walls and doors.He ruined our basement hallway with a paint sprayer and had to put new flooring in and it was installed improperly and he tried to charge ** Labor for putting in the flooring.The retainer wall still needs drainage and gravel put in and back filled.The contractor tried to is his insurance to get the walls redone ,but wasn't able to use him insurance He wanted ** to pay $1,800 to redue the Walls.When I told him we weren't paying for the walls to be redone he came and took materials that were paid for out of the deposit we put down.Also he didn't follow the ************ consumer protection act .He asked for more than one third down,he didn't provide start and end time for job,he didn't have me sign anything for the job that was agreed on,he didn't provide the toll free number for consumer protection act.,He abandoned the job by not finishing the work .We paid a $8,000 down payment to start the job. And it was not completed and what was done was not done properly.Business Response

I am writing this letter in response to the complaint filed from ******* *****. I was hired in the Fall of 2022 to complete a retaining wall in her front yard. Everything was just about complete, but the weather became too cold. We had a verbal agreement that the work would be completed in the Spring 2023, once it had warmed up outside. She was very happy with the work and asked if I would work on remodeling projects she had inside of her home.
The first project completed was repainting the basement (walls and trim). The paint was okayed by *******. We also remodeled the bathroom (including new linoleum floor) and plank floors in the basement hallways. Once this was complete, ******* stated that she was very happy with the work. She then wanted the upstairs to be painted as well. The only issue that had occurred was when the paint picked up from ****** had the wrong white base in it. Once this was figured out, I purchased more of the correct paint and repainted those areas upstairs.
She never voiced a complaint about the work until the painting upstairs was near completion. In order to try and make her happy, the walls were painted multiple times. I used my own money to keep repainting and priming the walls to appease her. According to her, the work was never right. She then decided that she was going to get a lawyer. That is when I pulled my guys and my things off of her property.
The upstairs painting was continually redone because it was not to her liking. I did not charge her for it to make her happy. There was nothing wrong with the workmanship itself, I was just trying to please her. ******* paid $8000 at the beginning of the work. I spent $2000 of my own money in labor and supplies to repaint for her. ******* still owes $3400.
I have attached pictures of the work. Please note the pictures of the completed work and also please note the opposing party pictures were from midway through the work. Please also note that there is no paint on the ceiling or floor. I am asking that this please be stricken from record.

I am rejecting this response because: Good morning, *************** to ******************. The first through fourth photos he attached is of the downstairs bedroom which is the only room that is not in my complaint. The lack of proper wall prep is clearly shown in my attached videos along with the use of incorrect paint on my walls, doorways, doors, and entryways. The lack of preparation and the choice of paint is causing my aforementioned surfaces to crack, peel, and bubble. The walls, doorways, and trim all have two different textures of paint on them and the doors all have a chalk-like film on them. My walls are two different shades of gray throughout my home. I am unable to wipe any of those surfaces down because it either leaves dark stains on the walls or a chalk-like substance comes off of the doors and walls. Fingerprints, marks, dirt, etc., do not come off. ****************** is failing to acknowledge that he purchased ceiling paint which he proceeded to paint my doors, trim, window frames, baseboard heaters, and entryways with. Originally ****************** was mixing the one-gallon bucket of gray paint with a five-gallon bucket of white paint himself in my garage, when he ran out of those paints he went to Lowes where he had them mix gray paint for him. He is placing the blame on ***** for giving him an incorrect color of paint, however, it is his responsibility to ensure the color is correct before he leaves the store and certainly before he uses that paint on multiple walls of my home. The fifth photo is of the living room which is only a partial picture and it is right after the first time it was painted. He did not include a full picture of the living room because he painted over the area where he pulled the baseboards off of the walls and failed to prep the area to paint it properly. The seventh picture he uploaded of the driveway is before he filled the cracks and sealed my driveway. The second picture of the driveway is after he filled and sealed the driveway; however, it is before he began building the new retainer wall. The 8th picture he uploaded is just a picture of the old retainer wall and you can see in his own photo he did not do a good job in filling in the cracks. The 9th picture is just a photo of the hole which was dug for the new wall to be built, it fails to show the inadequate retainer wall he put in which is still waiting to be backfilled. In the driveway, there's no paint or mortar in his photos because he hadn't started building the wall or painting the inside of my house yet. The 10th picture is of the new wall and if you look closely you can see the mortar on the driveway. The 11th picture shows the mortar as well. The 12th picture is of the new hallway floor that he had to put down because he used a paint sprayer in my basement and got paint all over the floor which he put down for free due to his mistake; however, he tried charging me $500 for installing it. He got paint on the floor where my washer and dryer were but did not put new flooring down or try to remove the paint off of the floor. The last few pictures he uploaded are of the living room before he painted that room. I tried every way possible to work with ***************** to correct all of the damages that were made to my home. I have attached four videos to attempt to show the damage to my home, however, due to limited space I feel I am unable to truly showcase how bad the damage truly is. He left his employees alone here for days on end with no supervision and when I asked him on two separate occasions to come to talk with me so we would be on the same page about the work he was not able to come to meet with me. Finally when he was able to meet with me the damage was already done and while he apologized for the lack of supervision on his part he proceeded to avoid responsibility by saying he did not know why the paint was cracking; peeling and bubbling. He blamed his lack of employees for ******* to get the job done but when he finally had what he said was an adequate amount of employees he still continued to rush the job. He did buy more paint but it was not the same color tone as the first paint and I told him I did not want him putting that dark paint on my walls .I am not paying for his mistakes, I allowed him to put the primer he chose on the walls in one of the bedrooms because he insisted that would correct the problem but it did not rectify the issues with the paint. ?When I addressed the bubbling of the paint he stepped outside and sat in his white suv claiming he was calling his insurance company to try and file a claim but later said he was unable to. March 8th was the last day any work was done to the house. ***************** texted me on March 9th wanting ** to give him $1800 to fix the paint issues and said if we paid him the money he would take it off of the cost of doing our driveway when the time came to do our driveway. Once I told him we were not giving him anymore money because of something that was not our fault he texted me on march 12th to see if we were gonna have someone else come in and fix it and if so he would need to get his stuff and a check for the remaining balance and he would still be coming to finish blacktop and backfill the wall. I told him we were not having someone else come fix the issues and that if need be I would be consulting a attorney because I would not be paying him anymore money seeing as the job is incomplete and inadequate. On March 14th ***************** came with ***** and *****, his two employees, and took his tools along with the materials for the job as well as the corrugated drainage tube for the retainer wall drain, which I paid for. The job remains incomplete due to his refusal to address the issues in a proper manner, he abandoned the job when I told him we would not be paying him anything else until the aforementioned issues were corrected properly. I am asking that ***************** pay to have all of the damages fixed that was caused by him and his company and the job completed. Attached is four videos to showcase the damage and poor quality of work done by his company. I have over two hundred more. I am asking this response NOT be stricken from the record./Business Response

It is unfortunate that **************** feels this way. All of the work done she was very pleased with until the very end when she decided it was all wrong. She even wanted me to hire on her son. It did not matter how much time or money I spent to try to appease her, she was never happy with any of it. ***************** knows he used the wrong paint on the walls,doors,door jams and baseboard trim. He used flat interior paint where he should have used semi gloss or satin paint. He knows the paint on the walls has contaminates on it and the paint runs only walls from the paint brushes are terrible. He knows he painted over my baseboard heaters with paint and did a terrible job on the driveway with watered down driveway sealer. I tried on several occasions to get Me..******* to make time to come to my house to do walkthrough and go over everything long before he abandoned the job. He was to busy to make time to come and do a walk through with me. He had to fire the first two workers for not showing up and had no crew to do the work and when he finally hired a crew he kept ******************* to finish the work that needed done .Mr.************; had his employees put paint on my walls without having them take the proper prepping steps and putting the wrong paint on and the end result was the paint peeling, bubbling and cracking. He was trying to extort money from ** to pay for his MISTAKES and when we refused to he abandoned the job and left our home a mess. The manner on which he operates his business is unprofessional and his ethic's are to be questioned.
