    My son, *******************, rented an apartment from McCool Properties at ********************************************************* (Chester County, PA) that ended on May 25, 2023. This was a standard lease developed by the ************************************. I paid the security deposit of $798.75.The security deposit has not been returned. The landlord has not said or demonstrated that there were damages to the property that would result in the security deposit not being returned. A few days after my son vacated the apartment he was hospitalized for medical reasons and di not did not notify the landlord of his forwarding address within 30 days (although his mail had been changed through USPS to forward to my address in Maryland). As per PA law, this does not allow the landlord to keep the security deposit, but impacts penalties imposed when a landlord does not return the security deposit. Since this summer, I have reached out to McCool Properties on at least five occasions requesting the security deposit back. The Office Manager said that she did not have the approval on her own to give the deposit back and would would speak to management. It has now been more than two months with no response to my continued outreach via email and phone. The landlord is legally required to give the security deposit back. I am seeking help from BBB to try and avoid pursuing my rightful money through small claims court.
