    I am a remote healthcare IT worker & temporarily living in PA as I have to go to hospitals once in a blue moon. I joined this newly established business(kickboxing & Jiu Jitsu training) on January 5th & fractured my ankle in their facility the same day due to which I mentioned this person named as ******* that I am on crutches & will be back to the gym in couple months. On January 5th before signing any documents I made it clear to ***** that I am not a resident of state & if I need to leave the gym for any reason or move out of state just in case I pay for 6 months would my money be refunded or not & he mentioned in clear words YES WE WILL REFUND for the months not used. Also to consider why would I pay $549 knowing that I can't get a REFUND. I was given two options to either pay $99 per month of pay $549 in total for 6 months. I signed the contract for $99 per month but due to injury that happened same day I mentioned *********** I am on crutches provided by doctor & will be back once recovered. He extended my membership to March 1st but I mentioned I will update him by March 1st(which I did on text) if I can walk or not(I have all the communications in messages). This person still charged my card on March 2nd even after letting him know that I cannot continue & when I mentioned about the charge on March 3rd he wrote whenever you'll be back we will adjust the amount for that month. I went to the facility on March 21 and mentioned ***** that hey I am thinking to pay for 6 months in full because I will be starting from April so why don't you charge the remaining of $549 (-$99 charged on March 2) and we can both get it over with for 6 months and he did charge. Note that for $450 charge on March 21 no receipt was provided neither it was mentioned NO REFUNDS! I worked out April till May 11th & didn't want to continue so asked for refund for which ***** texted that I cannot refund you your money! I texted multiple times. I have it all on text. THEY'RE SCAMMING PEOPLE. HELP!!!

    To whom it may concern,

     I received a letter of the customer's complaint and would like to add in my response. I understand that the response time has been closed off on the website so I'm emailing my response to the email that was attached to the letter. 
     The customer stated that he was looking to cancel his membership due to the fact that he is a remote healthcare IT worker and if he were to move away that i would refund his membership fee. That was never said, as it is in the contract that he signed there are no refunds beyond 12 midnight of the 3rd business day after the signature. The customer also decided to pay off his membership by paying in full which gave him a discounted price on the membership total and was aware that by paying in advance he would receive that discount. 
     The customer wanted to cancel his membership because he didn't like a decision that was made during our striking class promotional day and I do have the text messages between myself and the customer that would back up my case. There was no mention of him leaving the area or other reasons. Services are still being provided; therefore, if he wishes to return to classes he would receive the services he paid for. The letter I received mentioned to not include personal information but if the text messages are needed to settle the dispute I could provide that.
     The customer also requested a chargeback, which I have disputed and provided all the information mentioned above to handle this dispute accurately. There was no scam, the contract was signed, and I included a picture of our membership form which is the same one he agreed to.

    I am rejecting this response because:

    The contract provided by the business is of no use as it is not even the signed contract which was voided later. I joined and signed a contract on 1/5/23 which mention $99 for 6 months but as I mentioned to the business that I am not certain I will be here or not so I can't be binded for six months, they mentioned that's fine you still have to sign the document as it is ENROLLMENT AGREEMENT. My dispute has nothing to do with that signed contract. Later on March 20, 2023 I went to the business and mentioned since my leg injury (which happened on 1/5/2023 at their business)my membership is on hold, what if I pay for six months and if I still need to leave early for any reason you can deduct the monthly $99 for the last month I used your gym and refund me if any remaining upon which *************************** agreed and we ORALLY made the agreement and there was no writing or signed contract for this new agreement. The gym is still trying to convince that the earlier made contract 1/5/23 was never voided and as if there was never a new agreement which was made orally and hence even the business doesn't have any documentation to provide which I signed for $450 charge on 3/20/23 for which I am reporting my complaint that it was never agreed upon NO REFUND policy when *************************** made the new verbal agreement with me on 3/20/23.
    I have also alerted my credit card company and for me its not even about the money but they just cant cheat people to get money out of their pockets for establishing their new business. It took 12 days time to the business to let me know (after they tried to convince me to stay so they don't have to refund me anything) that they have “no refund policy” and they couldn’t say that in the first place when I asked for refund the first time on 5/11/23? All of the text message conversation can be provided if needed, please let me know. Please request them signed contract documentation for $450 which was signed on 3/20/2023 which mentions NO REFUND POLICY.
