AC Site and Septic submitted a quote for a septic job. When they knew they were beat they submitted a lower quote to secure the job. There was a request submitted with the contract to notify my the payer if there were any overages so I could verify myself providing accountability for the contractor. The bill was submitted for the original amount with bogus overages like gutters that were visible during quoting time. The company did not contact me nor provide any evidence that these overages were required or even completed.Business Response

This is a case involving a home that was sold to my customer, ***********************. I provided an estimate for services to design and install a new septic system. ***** stated I changed my estimate when I knew I was beat is not true. I changed my estimate after I was notified that the first estimate, I provided had included interior plumbing to the house to be fixed. I had previously based my estimate on the Home inspector that had provided info about the interior plumbing that it all was not going to the septic system and was going to the drywell. After being made aware that this was not the case, I provided my customer, ************** with a new estimate removing the estimated cost of the licensed plumber to do the work. I was notified buy my customer ************** to begin work on his property after the closing was completed. ***** mentioned that there was "bogus overages like gutters that were visible during the quoting time", well I never billed for any overages for gutters. The extras were for underground drain pipes coming from under the patio and into the new location of the leachfield. These pipes had to be relocated per the rules and regulations of the ************* I never billed for or said anything about gutters. Another one of his complaints is that I fixed the existing buildings sewer pipe that was pitched the wrong way after I exposed it from underneath the ground and noticed this. So I had to remove and properly pitch a section of the pipe the correct way by code. I only removed 6 feet of pipe minimal amount needed to get it to pitch the right way. I also tried to explain in writing to one of his earlier reviews that I have pictures of the work performed and even have pictures of the actual level showing the pipe being pitch the wrong direction. I assure you and as I stated to ************* holding the funds in escrow that everything I did was needed and only came into play because these conditions were underground and not know at the time the estimate was given. ************** the owner of the house was made aware of the few things that came up and had to be addressed. He was in agreeance that the work had to be done to properly complete the job to code and his expectations. I have pictures of the pipes, levels, new cement and wall work which was completed. I will also like to stated that I have done multiple escrow jobs and this is the first one that I had any extras added on to the estimate. The work I performed was necessary for the job to be Conformed by the *************, and if I did not do the work I did, the system would not have passed inspection. I understand ****** frustration that the funds come from the sale of the house, but the Banks have that in place to protect the purchaser so the job gets done and the seller doesn't try short the new Owner. I would also like to say that I feel I have been targeted by ***** solely because he's upset with the Banks procedures and after they made him aware of the how it works and what the rules are he's coming after me. I find his continual attacks on my service platforms nerving. I'm not sure when he will end. Please reach out to me If you would like to see the photos. I have nothing to hide. FAQThis is a case involving a home that was sold to my customer, ***********************. There are a variety of factual inconsistencies with the above response. Firs is this contractor seems to be confused on who the owner of the property was during the job. If you refer to the deed filed with the town of ******** you will see my name ***************************** living trust as the listed name of the owner of the property during the signing of the job. If you look on the contractors contract for the job you will also see Owner ***************************** Living Trust listed on their own internal contract with my signature. ************************** was not the owner of the property during the job as this is visible on all legal documents regarding this job. Additionally AC Site and Septic submitted a quote on 12/12/22 in the amount of $25,350.00. It wasnt until Brother ******* of ** submitted a lower quote of $22,500 because the job could be completed in a more efficient way costing less. This information was passed to AC Site and Septic to which they submitted a new quote in the amount of $22,000 on 12/23/22. The reason they submitted a lower quote is because they were aware of Brother ******* quote an were aware they would not secure the job without submitting a lower quote. A test hole document and contract was signed by myself Owner ***************************** on 12/30/22 with specific instructions to contact me if any overages arose, not so I could approve or deny them, but so I could verify with a third party that these overages were accurate and required to complete the job. The contractor refused to provide the owner myself with the ability to verify work. When the bill was submitted for overages to the bank with no evidence, and evidence was requested, no photos were provided just state links. No photos are available? Without the ability to inspect the image source and code I am unable to accept these photos as evidence as they were requested previously and not provided. I will note that the contact signed states by AC Site and Septic Also I would not remove/saw cut the patio as the existing septic tank appears to be above the patio.This is not in the plan for how we would be doing the repair. The contractor used this language because he was instructed by several parties that this is how the job would need to be completed and he refused to do the job that way. Then when the final bill was submitted the overages were listed as follows. saw cut and remove patio due to pipe being pitched wrong under patio, replace concrete.replace and re-pitch building sewer, and wall work Here we were directly charged for elements that the contractor insisted would not be done even though they were instructed to do so by several parties. When the final bill arrives it just happens to be less than $1,000 over his original quoted *****. Both myself, my attorney, and the real estate agent involved find the facts available to more than prove this contractors unethical behavior.

I will also like to stated that I have done multiple escrow jobs and this is the first one that I had any extras added on to the estimate. This contractor would like to know when I will stop exercising my legal rights as a homeowner and the questions is only when justice is brought and the funds that were unethically stolen from me are returned. I will continue to exercise all of my rights available and take this to the furthest point of litigation required to bring justice and closer to this issue. Nothing less.

Complainant continues to make up nonfactual claims against my company because he has exhausted his other options being turned down by the attorneys and bank which held funds in escrow. They have received and reviewed documents and photos for all aspects of the job and have agreed and confirmed all work done by myself and for the new owner of the home which I worked for was legal and necessary to complete the job to code and regulations.Customer Answer

My complaint is entirely factual and exposes the unethical actions by this contractor. I have proof of this unethical behavior, subpar work and lack of knowledge from this contractor. My previous responses prove this contractors actions, which you can see with the original quote, signed contract by myself and final bill provided by the contractor. I have provided this photo evidence and requested evidence several times from this contractor. I have provided evidence and he has provided nothing but false claims. The contractor took the job with a signed contract that requested advanced warning. This warning was not provided. If the contractor did not want to agree to this stipulation, they should not have taken the job. I was the owner, and I was the one who signed off on this job.This contractor should go to jail where he belongs, and I will continue to file complaints about this issue to ALL authorities involved and this will never go away until this contractor makes good on this legal contract that he drafted and I signed. I will not accept these bogus comments of me providing nonfactual information when I am providing photo evidence.
