    Dear BBB,
    I am writing this letter regarding the complaint filed by ******************* regarding his motel property located at ******************************.
    First, I would like to state that I do not do repairs,Iovino Appraisal Services, is a licensed ************************ which represents our clients during insurance claims as their legal representative licensed by the State.
    On January 10, 2024, I received a text from Mr. ******************* who asked if I could go to his motel to look at roof damage and water leaking into the building. I advised **** that I was busy, and I would get there as soon as I could.
    On January 18, 2024, I texted ******************* and asked him if he was in ******** today (as I was in the ******** area at this time) and he sent me the following four separate texts: No I am not, If you want to meet, I can come there What time, and Let me know. However, by the time I received the responses I was already out of ******** and in another part of the state.
    On January 23, 2024, I contacted ******************* via telephone,and he advised me that he was not there but that his cousin was there, and he could show me the damage.
    Upon arrival at the motel, I did a visual inspection of the roofs on both buildings and photographed areas of missing shingles leaving the decking open to the weather. Once I entered, I was able to speak with ******************* who brought me to the rear of the building motel rooms and upon entering several rooms they had active water leaks leaking through the ceilings onto furniture and flooring within the rooms.
    Mr. ******************* and I returned to the lobby, and I explained the process of hiring a Public Adjuster who is the legal advocate who handles the claim and makes sure the insureds understand that the insurance policy requires them to take the steps necessary to prevent further damage. In this case it was to cover the leaking roofs to avoid additional damage.
    Mr. ******************* signed the Letter of Representation /Contract and from this point it was our job to file the insurance claim with the carrier advising them of the wind damage to the roof and the water damages to the rooms identified.
    The next step in the process was to have a meeting set with the insurance company adjuster who I would be meeting on site. To be sure my client was following the terms and conditions of the policy and taking the appropriate steps to avoid further damage I had a local contractor check to see if they could cover the areas to comply with the above statement.
    It is common as the insureds advocate and licensed Public Adjuster to make these decisions as most people are not aware of the policy language and their responsibilities.
    Mr. ******************* had called me and asked why someone was on his roof and I again explained that the damaged areas had to be protected to prevent further damage, however he was upset that this step was taken.
    On February 14th I had a scheduled meeting with the insurance adjuster to inspect the property and discuss the claim and damages being reported. Upon arriving at the property, I spoke with ******************* who stated that he was not happy and was hiring someone else to represent him.
    It should be noted that under state law ************** had 3 days to rescind the Letter of Representation / Contract and this clause is stated on the front page just below his signature.  (see below)
    The insured may cancel this contract without any penalty or further obligation by sending written cancellation notice to the above address of ****** Iovino, PIA within three (3) calendar days from the date of this contract. If the Insured cancels this contract during this rescission period, you remain liable for any reasonable and necessary emergency expenses for services incurred to protect your interests.
    Mr. ******************* was now 22 days into the contract and this office could have held ************** to the terms of the contract. The contract states,
     The Insured hereby *********************** Iovino, *** to adjust all claims against the above insurance company for the above loss and as compensation for said services agrees to pay ****** Iovino, PIA ten percent (10%) of the total recoverable amount of the loss. The Insured further directs the above insurance company to name Iovino Appraisal as a co-payee on all insurance payments.
    In closing I would ask this negative remark to be removed as I, ****** Iovino, made no such physical repairs to Mr. **** Patels roof. And secondly, I took the measures necessary to protect **************** interest by adhering to the terms and conditions during a loss.
