    Agreed to a deck rebuild project in February on the 22-23, for the first week of April. Agreement included demo of current porch, and rebuild of new deck for the week of April 1st-6th. Deposit of $1500 cash was given on March 29th, to cover beginning of project, materials etc. Spent two days on demolish of project, minimum materials procured/delivered. Wednesday, April 3rd had 'personal' issues arrive and continued to blow us off about coming to work on project. Thursday, April 4th spent almost entire day with no contact from him, ignoring multiple calls, texts to try and get some communication. Finally got in touch with him after 4+ hours to find he had skipped on work and ignored us all day to help a lady friend. Came to an agreement that he would show at some point that day, the 4th to at least make some progress on the project as a sign of good will. Another 4 hours of waiting and had to again contact him, to have him tell me he was dealing with personal problems and would not talk, hung up on me. Have advised him I would like my $1500 deposit back, in full, and have filed a police report for Theft by Deception at this point, and will be passing it along to probate/small claims court if issue is not resolved promptly. Attached are pictures of work left undone on demolition of my porch, and the absence of said porch, which is both a hazard, and could cause potentials issues with me, my family, and our mortgage/insurance companies since we will not have an accessible entry point into our home for the foreseeable future.

    Upon receiving the funds from the customer. I was notified a day or two prior of the need to change plans on how the deck was to be demo'd no problem had to roll with it after all it's not unusual. So I did the best I could keep in mind the project had a limit of one week. It was a strick timeline for myself but entirely reasonable. Fast forward the day I was to begin homeowner notified me that more changes had to occur due to difficulty's at home with spouse lost 1 day for him to sort it out. After having previously built a deck for him I had a trailer available at the time unfortunately the same trailer was not usable for the second project so I just had to bring in loads one at a time. Did just that got rained out day 2 not a strong rain but none the less my tools are my livelyhood and to keep them running great I need them dry they are a big investment. So come day 3 finishing demo finally all but the posts are out of the ground and disposed of while I enjoy having the time to relax and talk to homeowners (I always considered it making friends as work and personal life can blur for myself) I was behind schedule and a bit stressed though that is no concern of the homeowner. It was none the less true I felt stressed about needed to take hour breaks to chat or come inside to eat though gracious and friendly they were I felt crunched for time. Posts were in ground after day 3. Day 4 had a personal matter to attend to yes someone was needing urgent help a lady friend of mine I apologized for the inconvenience but at this point though not the homeowners issue I was not going to finish in a weeks time trouble with getting help to show was paramount. However again this was not the homeowners fault. Day 5 running interviews homeowner calls irate and let's me know that I can not pick up my tools unless authorized by him so as not scare his wife and child so I did not return. Next day he demands repayment at a specific time of day which I could not do and full repayment was impossible as supplies were paid for on his property. He decides upon his own will to take all of my tools left at the job site and file a police report. So basically I felt I was in a catch 22 lose my tools or pay him more than he paid me for materials in order to give him the demanded amount. I still do not have those tools. I await my day in court. I'm not putting fault on the homeowner sometimes schedules through the best laid plans fall apart. However theft of the very tools I use to put food on the table is not ok. Sometimes the only way past an obstacle is to work through it even at a delay of time which I would still be very happy to do. However due to the day and age we live in the homeowner insists on being home while I work outside as is the case for his family I cannot say I fault him for that I may in similar circumstances desire the same. I would love to resolve the issue by completing if possible what I set out to do for the homeowner weather that's possible I do not know it made things difficult when he shower up at my unlisted business address with the police department in tow when he was holding the very tools I needed to work hostage. But as a man of my word I will honor it by completing his deck if he so chooses. For the agreed upon price (if it needs to be completed still) thank you for your time.
