    My wife ****** and I took ownership of *** *** ******** ****, ********* ** ***** on May 26, 2021 built by Shoreline Construction and Development located at **** ******** *******, ********* ** *****. The following describes the serious issues and remedies that we have faced at our expense throughout 2 years of ownership. Home was occupied by primary owners in March 2019. - Various times during year one of ownership; Five (5) out of eight (8) bathroom sinks become dislodged from its mounting and fell through their respective vanities. Cost = $4,500. - June 2022; All second (2nd) floor bathroom ceilings replaced. Not having installed an energy recovery ventilator “ERV” system(s) as specified causing major water damage to all of the second 2nd floor bathrooms. Cost = $15,000. - December 2022; Replace 2nd floor air conditioning due to improper installation and failure. Cost = $14,000 - June 2023; Rotted outdoor facade trim. Hardie board was originally specified and approved on all legal documents including building permits / approvals. Wood (non pressure treated) was utilized) despite approval process within ******** ***** ****** *** ****** ***** and The Town of ********. Cost = TBD. ***** ******* the owner of Shoreline has not assisted on any of the above and basically “washed his hands” of any accountability or wrongdoing. Irresponsible and non - responsive.     We respectfully submit the following response: 

    This is the 3rd owner of a 7 year old home.  Shoreline’s original client, who Shoreline actually contracted with, was a sophisticated owner in that he was one of the developers of the development in which the subject home was built. During construction, the original owner requested certain changes from the plans and specifications which were approved to the extent required. The home was built to the satisfaction of the original owner and all warranties were honored during their respective terms. 

    Shoreline disputes the current owner’s complaint for the following reasons:

    (1) The complaining owner (a) did not contract with Shoreline, (b) acquired the home 5 years after it was built, and (c) at least 4 years after Shoreline’s warranty expired. 

    (2) Because Shoreline did not contract with the current owner, Shoreline owes no contractual duties to that owner. 

    (3) The contract, to which the current owner was not a party, provided for a one year warranty as follows:

    Contractor warrants all materials, equipment, and workmanship to be free from defects for a period of one (1) year from the  of: (a) the date of Owner’s Final Inspection, or (b) the date of the issuance of the Certificate of Occupancy. CONTRACTOR’S WARRANTY EXCLUDES REMEDY FOR DAMAGE OR DEFECT CAUSED BY: OWNER’S NEGLIGENCE, MISHANDLING, OR ABUSE; ALTERATIONS, MODIFICATIONS, OR REPAIRS TO THE WORK EXECUTED BY SOMEONE OTHER THAN CONTRACTOR; IMPROPER OR INSUFFICIENT MAINTENANCE; IMPROPER USE OR OPERATION; OR NORMAL WEAR AND TEAR UNDER NORMAL USAGE.

    ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF FITNESS, MERCHANTABILITY, OR GOOD AND WORKMANLIKE CONSTRUCTION, ARE DISCLAIMED AND EXCLUDED.

    As such, any warranty obligations that would have flowed to a subsequent purchaser have long since expired.

    (4) The construction defect claims presented by the owner are subject to ***** ********** 3 year statute of limitations, which began to run from the date of substantial completion of the home. ** **** ********. Because this home was built 7 years ago, any legal claims the owner may have had against Shoreline are barred.

    (5) Even if those claims aren’t time barred, they are barred due to the owner’s failure to follow ***** ********** ****** *** *********** ** **** ********* ****** **** ** **** ********* ** ***.    

    (6) Further, we have tried on two occasions to call the current owner to discuss their comments. Neither call was answered or returned.

    Other facts to add. 

    1.)  We gave shoreline an opportunity properly remedy the situation  they refused and gave us a bill  for the improperly installed sinks  

    2.). In ***** ********, the general rule is that you have 8 years from the last date on which work was performed on your home.
