    We (Christina and Joshua Arey of 2091 Jessica Way, Navarre Fl 32566) entered into a building agreement on 9 June 2023 with Tm McBee of CRM Construction Management of Titusville Fl to build our house at 31 Oakwood Ave in Rockledge Fl. We got the loan approved Nov 2, 2023 and Tim was given $77,084.00 from the bank and $90,077.72 from us because he said he needed 20% upfront in order to start ordering things and doing permits. We did have some engineering things that needed to be complete before he could get permits. On April 30 he got everything he needed to file for permits and has not done so. On May 16th the bank emailed Tim and I and asked for an update. On May 17th I texted Tim to ask him to respond to the bank, he did not answer, on May 20 I texted again and no answer, on May 21 I called and left a message and no answer, on May 22 I emailed him and no answer, I also called him on the 24th and 25th of May to no answer and then I started to contact his wife and her business office and he finally reached out threatening harassment if I kept trying to reach him through his wife and in that email he said his lawyer said he can’t talk to us for 2 weeks. After doing a lot of research on him we have found out that he has 3 lawsuits against him and his license expires in 3 months. We sent a 30 day demand letter on 31 May to request our money back to his home, work, email and the FL Department of Business and Professional Regulations. Under Fl Statute 489.126 he is in breach of contract and due to the amount we payed him this could be charged as a second degree felony. See attachments for supporting docs.
