      I closed on a house built by Ferguson Construction on 6-24-2024. This house is located @ ****************************************************** *****. Soon some issues began to appear. The house is white trimmed in black. I noticed the black paint left behind was marked interior. I passed my concern to my realtor on 7-1, who passed it to the builder. ***** Ferguson. He assured her the paint used on the outside was exterior grade. On 7-26, I emailed a list of things that needed to be fixed, with no reply. Another email sent on 8-16 checking on the previous email plus some additional items to be fixed that included black paint peeling off the outside handrail. I told my realtor the peeling would happen. An email from ***** asking when I could schedule a time they could come. I replied, but no return call and no show. I sent another email on *****, asking when he planned to fix the problems. I also mentioned paying him $11,000.00 over his asking price and I wanted his answer. He replied via email, asking if they could come the following Monday. I replied that Monday was fine and asked what time they would be there. No reply and no show. I sent another email on *****. I broke down the different items, asking when each item would be resolved. To date, I have not received any answers.

      I am rejecting this response because:

      Here a a few more things that you will repair or replace.

       

      1.  There is a crack in the drywall on both sides of the closet in the master bedroom and the door jamb has separated.  The door will no longer close or latch..

       

      2.  I tried to open the door leading under the house to see if there was a support column under the wall in question ( there wasn't).  The door would not open.  I had to use a pry bar on it.  I found out the door and frame are not made out of treated wood.  Part of the frame splintered as a result.

       

      3.  The latches on several closet doors no longer hold the doors in place.  In fact the latches in the top of the doors no longer even touch the keepers.

       

      4.  The front door now hits the jamb and has to be forced open and shut.  The paint on the door edge is being scraped away as a result.

       

      5.  Problems with the drains in both bathrooms.  Two drains won't latch and two drains won't release.

       

      6.  Where are the keys for the doors that have privacy locks on them?

       

      7.  One of the smoke alarms is defective.  I replaced the battery, but that did not solve the problem.

      Good morning! I apologize you had that problem with the gutters, we use the same gutter installer on all properties and havent had a problem but I will be glad to send him there if its good with you for him to repair? Leaf protection systems are up to the homeowner to get installed if they would like them! Thanks!

      I am rejecting this response because:

      Next Wednesday the 12th will be fine.  Do you plan to have the gutter people and the surveyor there?  You also need to have your landscaper to come by and pick up the chunks of asphalt and concrete that he buried in the berm he put around the my yard.  I am quite sure I have not uncovered all he buried.  He can also replace the two plants that died.
