      I filed a request to have my air conditioning unit repaired on March 23, 2024 and the work was started. However, to date the work is not completed because the contractor keeps cancelling and rescheduling finishing the job. It's been almost 3 (three) months now and it's still not done.

      Ms. ******* and I entered into an agreement with LCB Contracting Solutions for Pre-Construction Professional Services agreement signed on May 20, 2022 in the amount of $40,000. $30,000 to be paid immediately and the remaining $10,000 when the Notice to Proceed_Residential Construction Agreement was signed.

      We decided to cancel the Residential Construction Agreement when we found another builder who could start the build on our home immediately and within the $800,000 price range originally quoted to LCB Contracting Solutions.
      We notified LCB Contracting Solutions on October 13,2022, that we are canceling the pre-construction professional services agreement. I requested a follow-on discussion with Mario H*****, company owner and CEO, about the services rendered and any remaining funds that are expected to be returned to us.
      Later that day, we had a brief conversation with Mr. H***** who agreed the 10k should be returned immediately and he would confer with his team on the remaining amount.
      After our notification to canceling the agreement, Mr. H***** did not respond to my numerous telephone calls and emails to provide a follow-up on our previous discussion. On December 6, 2022, a former LCB employee, Kenneth B*****, contacted me requesting my financial institution information. As requested, was sent to Mr. B***** and Mr. H***** via a text message. Several days later, I noticed a deposit of $12,500 in my bank. We never received any communication from Mr. H***** about the timeliness of the deposit or to discuss the refunded amount.

      I sent another email to Mr. H***** on December 8 requesting a written breakdown of the services rendered and the cost of those services. Mr. H***** responded to the email acknowledging receipt of the email, and he was available to discuss our request.

      As of today, we have not received an invoice outlining how the funds were used especially since the company only complete 3 of the 6 activities in the agreement.

      We (LCB) worked with Mr. and Mrs. ******* for nearly 1.5 years trying to redesign, value engineer and provide construction cost estimates for a house they wanted to build on their land.  LCB was not the first construction contractor to price the ******* home as prepared by their architect.  Like the others prior to us, LCB came up with an initial price to construct the home that exceeded $1.3mm.  After working with the *******'s and their preferred lender in "good faith" for approximately a year, trying to find a price point that would fit the *******'s budget, LCB was ready to abandon the project and discontinue the process.  However, further discussions with the *******'s, LCB that we could no longer provide professional services for architectural work, value engineering and construction costing without a formal agreement for professional services.  At that point, LCB presented the *******'s with a Notice to Proceed agreement for $40,000.  This agreement is/was standard FEE SIMPLE/FIXED PRICE contract for professional services to include but not limited to doing what was necessary to redesign the home, provide architectural drawings (including structural engineering and MEP drawings), and permit a house plan for construction for the a *******'s that would fit their budget (estimated based on lender input to be approximately $800,000).  This contract was broke the process down in to major components which described the scope of work.  To ratify the Contract, LCB agreed to take an initial payment of $30,000 grom the *******'s as a intial payment against the $40,000 balance (with a verbal agreement that the *******'s would pay the $10,000 remaining balance once LCB was ready to submit plans to the structural engineer).  LCB then began to work to complete all components of the contract including working with the *******'s lender to get certified as an authorized VA lender.  During the course of the agreement (approximately 5 months in duration), LCB redesigned and re-priced the home 3 additional times (a total of 6 times throughout the course of the 1.5 year interactions with the *******'s).  Following each iteration of the redesign, input and direction was solicited from and provided by the *******'s prior to starting another round.  Finally after 6 total rounds of redesign and consulting, LCB succeeded in finding a plan the met all of the criteria necessary to meet the *******'s requirements.  Once this was complete the *******'s were notified that the plans were ready for the final two steps in the process (i.e., submitting the plans the structure engineer for a stamp and then permitting the plan which included paying for the permit and cooresponding tap fees as required by the governing municipality).  As discussed when LCB took the initial $30,000 payment against the $40,000 contract requirements, the *******'s paid the $10,000 balance due, with the full understanding that it would be approximately 6-8 lead time on the structural engineer returning the plans so they could be permitted for construction.  Approximately 2-3 weeks after the plans were submitted to the structural engineer, the *******'s decided to break the contract arrangement with no fault to LCB, stating that they found a better plan and new builder.  At the time LCB was informed of this decision (with the understanding that the *******'s broke a fixed price contract), LCB agreed "in good faith" to return the last $10,000 paid by the *******'s as LCB estimated the cost of paying the structural engineer, permitting and taps fees to be $8,000 to $8,400.  However, at the time that LCB agreed to return $10,000, the *******'s requested a $20,000 contract concession.  I (Mario H*****) as the owner of LCB, told the *******'s I would have to look into the details of the contract and the services we provided before I could agree to provide a concession greater than $10,000.  After discussing the details of LCBs activities during the entire relationship with the *******'s, and under no legal or contractual obligations, LCB wired the *******'s $12,500 as an act of "good faith" in Dec of 2022.  Since the receipt of the wire and the *******'s dissatisfaction with the amount given back to them, there has been a series of emails exchanged by the *******'s.  LCBs attempts to have a phone and/or Zoom meeting to discuss the matter have not resulted in a virtual or face to face meeting.  Hence, the latest interation has been this exchange via this pending complaint.  LCB stands firm in the fact that all contract requirements were performed and compensated in accordance with the agreement and that the *******'s broke the contractual agreement with no fault on the part of LCB.  LCB contends that it has gone above and beyond the call of good faith interaction by giving the *******'s a greater than 30% concession on the fixed price contract despite no wrong doing.  If attempts to resolve this matter without further complaints and allegations of wrong doing continue from the *******'s, LCB will have no recourse than to solicit legal counsel to resolve this matter.  A copy of the contract is attached.

      I am rejecting this response because: The agreement with LCB Contracting
      Solutions never references value engineering or architectural value and it was explained
      during numerous discussions this was all inclusive to the pre-construction professional
      services agreement. In my December 14th email to Mr. H*****, we requested
      an invoice outlining ALL pre-construction professional services rendered from
      May 20, 2022, the date both parties signed the pre-construction services agreement
      to the termination notice dated October 13, 2022. As of today, LCB Contracting Solutions
      has continued to deny our requests for a detailed invoice of costs associated
      with the agreements.

      Ms. ******* and I have communicated
      in several emails we are willing to meet with the owner once an invoice is provided
      so it will allow both parties to have reasonable discussion to resolve
      this situation in an amicable manner.  Mr. H***** states “There is no hourly breakdown that we tracked as a component of
      the contract”. We find this statement to be extremely difficult to believe considering
      his company has given us projected costs estimates for the build but unable to delineate
      the type of preconstruction services rendered during this time frame.

      We decided to end
      our relationship with LCB Contracting Solutions because we lost confidence in
      their ability to build the home because we found out from our mortgage lender
      that LCB Contracting Solutions had been subject to several lawsuits.  When the lender reached out to LCB Contracting
      Solutions questioning the reasons for the lawsuits, they were nonresponsive to
      the inquiry and the lender notified us of their concerns.  When we reached out to LCB Solutions about the
      inquiry, they did respond to the lender but never elaborated to us about the
      lawsuits.

      At this point, we
      began meeting with other builders and was able to find a builder with a strong reputation
      that guaranteed to build our home with all our desired features for 100K less than
      LCB Contracting Solutions price quote of $850,000 which excluded the site
      preparations (i.e., clearing of the land, etc.). The new builder’s price quote included
      all costs for the site prep.

      This could have
      been resolved with detailed breakdown of preconstructions services provided,
      and a fair and equitable return of funds not expended based on the preconstruction
      professional services agreement. I have attached the email messages with Mr. H***** about the outstanding funds.

      Mr. and Mrs. ******* have been given every opportunity to meet and discuss their grievances concerning this claim but have refused to do so.  Instead the *******'s have choosen to try to attempt damaging our companies reputation through the court of public opinion via this BBB complaint.  The fact of the matter is that the *******'s chose to terminate a contract with LCB without cause prior to the scope being finished (LCB only needed to turn the plans into the permitting office, and once assessed, pay the appropriate permitting and impact fees to begin construction).  In "good faith", LCB returned more than 31% of the contract value to the *******'s with no legal or contractual obligation to do so.  Now the *******'s feel as if LCB's actions were not as aggressive as they would like.  But instead of discussing the issue they have chosen this BBB complaint path. Thus costing LCB more time and attention to a contractual matter that has no legal merit.  LCB suggests, that if the *******'s sincerely feel they are do additional funds reimbursement as a result of their contractual default; they seek legal remedies to be made whole.
