      Today, 2/14/23, Mr. Steve ******, agreed to send me my $2500 reimbursement deductible, in an email at 9:34am. A few hours later, he said he was not going to issue the check. I have a long paper trail to support my position on this issue.

      This is in response to BBB complaint regarding reimbursement of $2,500 deductible for his insurance claim. He has been advised that the subrogation recovery money is going to the Florida Receiver's office, as it was the insolvent carrier who had made the payment on his claim. Therefore, the $ 2,500 deductible reimbursement will be made to the insured by the Florida Receiver's office. This has been explained fully, verbally and in writing, to the insured after Steve was informed the recovered money would be sent to the Florida Receiver's office.

      The SC Guaranty Association only received this claim, due to the liquidation of Mr. **** insurance carrier Southern Fidelity on 6/15/22. Steve ***** is a independent adjuster, not a employee of the SC Guaranty Association. When we received the claim from the Florida receiver, the subrogation recovery efforts were already in process and SFIC's attorney was handling pursuit of recovery from the manufacture. Steve did not know until he was told by the SFIC attorney on 2/14/23, that the money had been recovered and would be sent to the Florida receiver's office, as SFIC had made the payments to Mr. **** for his claim. He was advised same day by Steve of the above facts. Until that time, Steve was under the impression the subrogation recovery money would be sent to us for distribution.

      I am sure Mr. **** has received or will be receiving his share of the subrogation recovery money for his deductible that he is due from the Florida Receiver. The SC Guaranty Association has no legal obligation regarding his claim, per the above facts.
