      Transaction Date: November 18, 2022 - Transaction Amount: $5000 - Merchant Name: The Barndominium Co - Description: Paid $5,000 for custom home architectural plans & drawings as well as an itemized invoice for the total cost of the house build. Plans were not usable and incorrect, after multiple conversations regarding wants and needs. Itemized invoice for house build was never provided. We sent the house plans to lumber yards to start getting quotes for the build and we were essentially laughed at and told that the plans were not usable in the slightest and we needed to have a professional re-do them.

      I have attached the original Design Phase Acknowledgement Contract that the client signed when funds were transferred. It clearly states, as I have highlighted for proof, that the design phase is NON REFUNDABLE, that the design phase IS NOT A CONTRACT TO BUILD, and that the design phase is ONLY to design a floor plan and to visit the site and create a game plan for construction. A final proposal was also emailed to the client and is referenced in attached emails. The client was never under contract to build with us and there was never a "deposit" paid. There was a transaction for design services only and services to provide a cost to construct. Both of these were delivered to the client. I have attached a fully executed set of blue prints and circled the completion date on the cover page. I have also attached emails of clients acknowledgment that our land development team was on site and conducted the necessary numbers for pre construction costs. I have also attached emails of the client confirming that they received their proposal. The client is frustrated about "construction related items" such as flooring finishes, siding colors etc. All of these items would be relevant if we were in a construction contract or had entered into an agreement to build their home. We never entered into a construction agreement. The plans have been delivered, site visit conducted, and proposal for construction delivered. The terms of our contract for the $5,000 have been completed. There is no reason a refund should be issued as the client has retained the copy of these plans and we sell these plans universally across the country as "DESIGN SETS". There is nothing in our terms of service about "engineered plans" being included in the design phase acknowledgment that was signed and executed by the client. However, I did attach an additional email where they were informed that should they elect to build with us we will charge $1,500 for the engineered set at time of construction for permitting only. The client acknowledged this email and is fully aware of the process. 

       

      The client also blackmailed our company, as per the attached email, that if we weren't quick to agree to her terms for a refund that she would go online and threaten our reputation. This is illegal and highly uncivil. We have satisfied the terms of our agreement as per the attached contract with the Client and neither party wishes to advance to construction. No refund is due. This matter is fully satisfied. If the client wishes to pursue civil action she has been provided with our attorneys information as she fraudelently claimed to have retained an attorney in her emails to our sales agent. At which time our employee did what is company procedure and stopped the conversation and requested that all future inquiries be submitted through the proper legal channels.

      Better Business Bureau:

      I have reviewed the response made by the business
      in reference to complaint ID ******** and have determined that this does not
      resolve my complaint. 
      The ‘plans’ that were provided
      are unusable. There are discrepancies in measurements on roof lines,
      elevations, door openings, room sizes, missing windows in the window schedule,
      the list goes on. These items were not realized until I had professional’s
      review. A ‘site visit’ was NOT conducted. The builder sent out a subcontracted grader to view our land. This Grader lived over an hour away, would need to
      rent equipment to work on our land, and had no established relationship with
      the Builder. They were simply a subcontractor. We were told that someone from The
      Barndo Co, an actual employee or possibly one of the owners would conduct this
      site visit that is mentioned. This never happened. A final proposal was NEVER provided
      to me, the client. I received a handwritten, rough draft of a packet that I had
      filled out during a zoom call.
      To recap, the plans
      delivered are not usable, a site visit was never conducted and the proposal for
      the construction contract was never delivered. NONE of the terms for the
      non-contract contract have been completed.
      I did not retain a copy
      of the plans because they are not useable. You are right in that engineered
      plans were not included in the terms. However, it wasn’t disclosed that they weren’t.
      I asked about this in an email after I received feedback from lumber yards that
      the plans were laughable and had a lot of errors.
      I most certainly did not
      blackmail. I professionally suggested that they be professionals, acknowledge
      that they did not deliver on any front with what they said they would, and it
      would be in their best interest to process a full refund. I am fully in my
      rights to share my experience with this company on social media. TikTok, Google
      Reviews, and Facebook Group’s are places where consumers should be able to
      share honest opinions.
      I have attached further communication
      from Jeff F**, showing the follow up email from the non-communication. The
      handwritten attachment in an email they are considering the “proposal for
      construction contract”. Also, the email from Olivia, the sales consultant,
      stating that what she was providing for the proposal as incomplete.

      The completed plans have been uploaded to this portal previously. We also have proof of a site visit being conducted by our grading contractor, which the client also has verified multiple times in their statement. There is no communication from The Barndo Co. that the owners of the company would personally visit their site and conduct a site visit. We entered into an onboarding fee with a clear understanding. This fee was to cover design only and include a site visit. The client acknowledged this when they electronically signed and submitted their payment. The client additionally acknowledged at time of payment and again in an email to our sales agent, Olivia F*****, that the fee was non refundable. The work has been completed, the client has received the plans, the client received an estimate to do pre construction site prep. The client received a proposal to build by The Barndo Co. The proposal was considered "incomplete" only because the client had not yet selected all of their finishes. The client is no under contract to build with our company. The client received 100% of items that were guaranteed when they onboarded. A refund will not be issued.

      Like I’ve said in previous
      communications, the plans are not usable. Per your Barndo Co guide, on Pg 7 of
      the uploaded PDF, you specifically mention that ADA compliance is what you are
      passionate about. AND I mentioned on several occasions that my husband is a
      100% permanent and total disabled veteran and I need doorways to be wheelchair
      accessible. The plans “completed” have 2’ 8” doorways? How are these “plans” in
      any way complete and useable.
      There was not a site visit
      completed. Again, per your 2022 Barndo Guide, and per my conversations with Olivia, you would “make a site visit and perform site evaluations for proper foundation and
      site improvement costs”. A subcontracted grader does not perform entire site evaluations
      and estimate improvement costs to build. The grader made it clear to us that he
      was only quoting grading services and someone else from the Barndo Co would
      come out. Your Team also told this directly to our face, when we visited your
      office, that you would be personally visiting our site regarding the final
      construction cost/proposal. How could you properly gauge the cost of an entire residential
      construction project and prepare a contract to sign without ever being on site?

      I most certainly did not
      SIGN anything. The “work” was never completed, I have never received an
      estimate to do pre-construction site prep, and the final proposal was never
      completed. We did select the final finishes on a zoom call with Olivia on April
      28th at 10:30am, so the proposal wasn’t incomplete because of me.
      Also, your designer just
      replicated what I provided to him on January 25th. He did not design
      anything. That was 100% my floor plan and design. All he did was build it in
      his software and put his and your company’s name on it.  
      We, the client, did not
      receive 100% of the items guaranteed! How can you professionally say that you,
      as a company, delivered? In my opinion, it is crucial for businesses to
      prioritize customer satisfaction and address shortcomings transparently. Your lack
      of ownership is concerning.
