    On January 17, 2025, I entered into a contract with Executive Construction Homes using a Veterans Affairs Loan. Initially, the closing date was set for the end of February 2025. However, I was later informed that the home would not be ready until April 16, 2025, which became the new closing date.

    As is standard with VA loans, a VA appraisal was conducted, which unfortunately came in below the expected value. The builder's asking price was $454,500, while the appraisal valued the property at $430,000. We requested that the builder reduce the price to match the appraisal value, but they refused to negotiate. Faced with this situation, I had no choice but to walk away from the purchase, as the VA would not authorize the loan at the higher price. I subsequently requested the return of my earnest money in accordance with the VA escape clause. This clause offers the buyer three options: negotiate the price to match the appraisal (which I attempted), pay the $24,500 difference out of pocket, or request the earnest money (which I chose to do). Attached are the signed escape clause, the builder's feedback regarding their refusal to negotiate. After the builder declined to lower the price, I looked for a new property and requested my earnest money, 10 days after, the builder decided to reduce the price.

    I believe this situation reflects unfair practices and bad faith on the part of the builder. Both my real estate agent and the builder's agent, along with the closing attorney, advised me to wait for the home to go under contract for the release of funds. However, given that the appraisal was lower and the house was already sold, I am disappointed that the builder continues to refuse the release of my earnest money.

    This builder's actions raise concerns about their compliance with legal obligations, and it would be prudent for them to be monitored to prevent future issues, as they seem indifferent to the agreements they have made.

    We are in receipt of the recent consumer complaint submitted to your office.

    However, we were advised by a representative acting on behalf of the consumer that this matter is resolved. This understanding was formalized in the attached addendum to their contract, which includes a clear statement from the consumer agreeing to rescind all current and future complaints. Given this written agreement, we are unsure how to appropriately respond to the current complaint, as it appears to contradict the terms and resolution already documented and agreed upon. Also attached is delivery confirmation of the funds in question.


    We respectfully request clarification on how to proceed and whether the information provided in the attached documentation resolves the issue from your standpoint.

    We purchased a new home 2/23/24 the home has foundation exposure casing the drywall to crack in every room of the house. The builder refused to correct issues. Said the would fix but lied about how. When we told them they tried to make us sign a liability agreement removing all warranty on entire home. The agreement stated work was completed! Before they would even start work. The other houses didn't sign anything but received work. It is fraudulent misrepresentation and illegal!

    Good afternoon, 

    We are in receipt of this complaint dated 12-10-24 and we appreciate the opportunity to respond. With over 30 years of experience in the homebuilding industry, Executive Construction Homes LLC takes homeowner concerns very seriously. We are committed to providing quality built homes and addressing any issues that arise to the best of our ability. 

    We would like to offer the following sequence of events to provide a comprehensive understanding of the situation and the efforts made to date to resolve this:

    August 12, 2024: Homeowner (Mr. *****) came to the office in a visibly irate state and told office staff that the foundation of the home was ‘washing away.’ Showed photos but refused to give any additional information as he was considering his ‘options.’ Later that evening, Mr. ***** emailed the three photos shared with office staff (see attached). 
    Warranty Department replied to Mr. ***** (see attached) in appreciation and notified him that the warranty representative, J. L*****, and vendor for the slab/foundation (********* ********) had been contacted and would be on site within days to do a visual inspection. 
    August 14, 2024: Homeowner (HO) notified that vendor and Mr. L***** would be on site today (see attached). 
    August 15, 2024: Verbal report from vendor that there was no evidence of foundation settling. However, there needed to be backfill at the turn down and positive drainage created in the front of the home (see attached). Vendor further reported that the HO was very aggressive and threatening in tone/ nature with him and he preferred not to return to the site unless it was absolutely necessary.

    Owner Eddie Y***** was informed of these findings and immediately requested a consultation with a licensed structural engineer. The engineer was tasked with conducting a thorough on-site inspection and providing detailed conclusions and recommendations to address any identified issues based on the findings from the investigation. Because four (4) homes on this street were constructed at the same time, Mr. Y***** wanted these  four (4) homes assessed and any recommended follow-up work to be done at all homes instead of only assessing and working at the one home we received the warranty report for. 

    August 20, 2024: *** ***** P.E., President of ***** Engineering Services, contracted with *** ****** (structural engineer) P.E., M.B.A., of ****** ************ *********** to provide this inspection and report. 
    August 21, 2024: HO’s notified via email that a structural engineer would be conducting an inspection 8-22-24 and would need access to the exterior of their property (see attached).  
    August 22, 2024: Mr. ****** (structural engineer) and Mr. L***** visually inspected, photographed the exterior of the home. Mr. ****** spoke with the HO directly re: his concerns. 
    August 23, 2024: Additional information was provided to Mr. ****** (plot plans, house plans, compaction study). 
    September 1, 2024: Report from Mr. ****** received (see attached). NO structural damage as a result of erosion was identified though some of the footings were exposed. Engineers repair protocol included minor grading to create positive slope, adding dirt for multiple purposes, cutting of swales to direct water away from the homes, planting sod to stabilize the newly placed soil. Owner/CEO concurred and requested vendors and quotes be located so the  work recommended by the structural engineer could be scheduled. 
    September 11, 2024: HO notified of findings from Mr. ****** in that there is no damage to the structure of the homes although preventive erosion control maintenance measures were recommended to be put into place. HO further notified that this scope of work was being refined and we were awaiting quotes from vendors in order to get the work scheduled (see attached).  
    September 11-October 5, 2024: Four vendors were requested to visit the homesites, review the scope of work recommended by the structural engineer and provide quotes and scheduling availability. HO was notified vendors would be looking at the exterior of the home during this period of time. Two vendors were threatened and intimidated by Mr. ***** while on site to do estimating and refused to quote the work. 
    October 5, 2024: ****** **** Landscapes provided a quote which was immediately approved and this work was scheduled for October 15, 2024. 
    HO notified of this and asked to advise on/before October 11, 2024 if we did not not have permission to access their property and do the work recommended by the structural engineer with NO release being required from HO (see attached).  
    October 7, 2024: Ms. *** ******* (HO--partner of Mr. *****) emailed (see attached) and inquired as to the scope of work that would be done. She gave permission for the work to be done but stated the following: ’We give you permission to do the work, however please note that we DO NOT believe this will be the final solution set to the issues we are having ‘
    She was provided this information as well as a copy of the compaction study done. Work was scheduled with vendor and NO release was required of HO's. 
    October 9, 2024: Email again from Ms. ******* requested a date which was provided. We also further followed up to her 10-5-24 email to reiterate that the structural engineer found no damage to the foundation of the home and the preventive work being offered was being done in good faith as the builder to address the concerns brought to our attention. No further remedy is indicated or would be done beyond what had been recommended by the structural engineer. We requested affirmation that we still had permission to proceed with the work recommended by the structural engineer (NO release was asked for). 
    October 13, 2024: Ms. ******* was emailed again inquiring if we had permission to proceed so vendors could safely access her property on 10-15-24 (NO release was asked for) 
    October 14, 2024: Ms. ******* confirmed we had permission to do the work recommended by the structural engineer but further stated she did not think this solution would fix their concerns and inquired if anything had to be done to prepare for the work (see attached). She was advised to clear the perimeter of the home of any items that she would not want to be affected by dirt and sod. She inquired if we would be removing and replacing (rebuilding) the back porches in the rear of the home. She was told no structures would need to be moved in order to complete the work recommended by the structural engineer (see attached).  NO release required of HO.

    10-14-22: Later in the day, Mr. ***** then joined the email and replied with the following: 'How do you think this is going to help? The bottom of the foundation is eroded and exposed 3 inches past the concrete. Just to get to the foundation you will need 4-6 inches a***** the ENTIRE wall' (see attached).
    He was advised by warranty staff that the work recommended by the structural engineer including backfilling, grading and stabilization did not require removing existing structures added to the homes since closing (see attached). 
    At 5:09 pm Mr. ***** emailed the following: 'We do not want the work you are offering. We have filed a complaint with LLR, and have hired a licensed STRUCTURAL ENGINEER. We will not allow any work to be done until LLR and investigated and the report has been made' (see attached). The work scheduled for his home was cancelled.

    10-15-24: ****** **** (vendor) on Emerson Rd completing preventive erosion control maintenance work at three (3) other homes as recommended by the structural engineer. Mr. ***** approached our vendor and then contacted our office now wanting this work done (see attached). In consult with executive staff, it was recommended that due to the threats by Mr. ***** and Ms. ******* stating on at least three (3) prior occasions, all noted above, that this work recommended and designed by the engineer would NOT address their concerns we would ask for the HO's to sign a release.  Mrs. ******* refused and therefore no work proceeded at their home. 

    October 19, 2024: Site visit made by company staff to the other three Emerson Rd homes to view the work completed by ****** ****. The work was performed perfectly. As these four (4) homes are side by side and were built at the same time, it made sense to us as a company to try again to get this exterior work completed at *** ******* Road.  We decided to reach out once again to Mrs. ******* and Mr. ***** and see if they had changed their mind re: allowing the work and we would not require a release. 

    October 21, 2024: Emailed HO and offered to schedule the work recommended by the structural engineer. Told them no release would be required and if they gave us permission for vendor to access their property we would do our best to get this work scheduled as soon as possible (see attached).
    October 22, 2024: HO declined the work to be done (see attached email). 

    Despite constant challenges with HO aggressive and hostile behavior towards all staff who have come to his homesite, we continued over several weeks to engage with good faith effort to address their concerns, demonstrating our commitment to customer service and problem resolution. We were committed to completing the work recommended by the structural engineer at this homesite but were not allowed to do so based on the HO comments as detailed above. They clearly refused in writing to allow the work to proceed even when the request for them to sign a release had been rescinded. Also please note, the work was offered on five separate days without the mention of a release. A release was only introduced into this situation on one occasion, 10-15-24, after the company had been threatened with litigation, SCLLR complaints and told on multiple occasions in writing by the HO's that what we were doing would not solve their issues. The request for release was rescinded on 10-21-24 when we made contact with the HO asking if they would give permission for the work to be completed and no release was needed.  That offer was declined. 

    In closing, we reiterate our dedication to providing quality homebuilding services and to addressing customer concerns with diligence. We take pride in our work and in the satisfaction of our homeowners. Given the extenuating circumstances perpetuated by the homeowner, we believe that we have h*****d this situation to the best of our ability to date; yet, remain committed to finding reasonable solutions where possible.

    We would like to clarify that there has been no communication between Kershaw County and Executive Construction Homes regarding this property since the Certificate of Occupancy (CO) was issued 10-25-23 (see attached). It is important to emphasize that a CO is only granted after the home successfully passes a series of rigorous inspections conducted throughout the construction process, culminating in a comprehensive final inspection. These inspections ensure compliance with all applicable safety and construction standards. If the municipality had an issue with construction of this home, this would have been brought to our attention, construction would have been halted and, certainly, a final inspection would not have passed nor the CO issued. 

    Furthermore, we respectfully dispute the homeowner’s assertion that these concerns were brought to our attention prior to their closing. Attached, you will find the final walk checklist, which was signed off on by both homeowners prior to finalizing the closing for this property. This document confirms that all items noted at the time were addressed to the homeowners' satisfaction. It defies logic that the homeowners would have proceeded with the purchase of the home if they believed the property suffered from the type of damage they are now alleging. The fact that no such concerns were documented on the final walk checklist only further supports this point.

    Additionally, as noted in the prior response, and most important to keep in mind is this property has been professionally assessed for structural damage and no such damage was identified. For ease of reference, we have included again the structural engineer's report, which substantiates this.

    Throughout this process, we have made every effort to address the homeowner’s concerns in good faith. We offered to perform preventive erosion control maintenance work recommended by the structural engineer work to address perceived issues but the homeowner declined this as recently as October 22, 2024. 

    We are confident that we have acted responsibly and fulfilled our obligations in this matter. Should you require further information or documentation, we are happy to provide it.
