      My stepson, *******************************, canceled his Anytime Fitness membership effective as of October 9, 2022. I've attached a copy of the termination letter. We paid 1/2 of the remaining membership fee as a termination fee per his contract (which is also attached). I know that Anytime Fitness received the notice because they cashed the $187.50 check and stopped charging our **** last fall (we put ******* monthly fees on our ****). However, starting January 2023, Anytime Fitness started charging our credit card again. It was $17 in Jan. $25 in Feb. And $34 each for March thru August 2023. I contacted **** and disputed some of the charges, but most were outside the 60-day window for disputes. Even so, **** credited us $17 for the January charge and $68 for the July and August 2023 payments. I emailed Anytime Fitness about this and got a response that ******* account was terminated on September 9, 2023, which isn't true, but must be what's in their records (I've attached these emails). This past Friday, I received an email with a FINAL NOTICE banner indicating that Anytime Fitness was going to charge our **** $43. I tried to call the "800" number, but wasn't able to reach a human. I replied that if they charge our **** we will bring an action under the Fair Debt Collection Practices Act. Copies of these emails are attached. Last week, I sent **** mailed notices to the two LLC Manager addresses for *** Fitness Solutions, LLC, the franchisee of Anytime Fitness, demanding a refund of the March thru June overcharges plus the February charge, for a total charge of $161. This letter also is attached. We would appreciate your ensuring that ******* account is terminated as of the original termination date, that our **** is not further charged, and that *** Fitness Solutions refunds the illegal **** charges.

      This was my email conversation today to ******* (I just copied it below). I will attach a statement for the cancellation and the refund I did today.

      We got a notification from the BBB about the gym membership of your stepson *******************************. I tried to call you today and left a VM, but in addition to that I will write you this email statement and cc in the owner of the gym.
      My apologies for the issues that you experienced with the cancellation of *****. I reviewed all your documents and you are totally right. The membership should have been cancelled since 8/27/2022.
      Here is what happened . You addressed all your communications to *** financial and not to the gym of your son (Anytime Fitness *******************). *** financial is just partner of the ** franchise and is in charge for all the payments. They should have never endorsed the check. This is only possible from the gym owner. They should have forward your cancellation request and the check to us. 
      We never got anything from them, thats why your son still got charged. I will investigate with *** financial why all those mistakes happened . But that is not your problem.
      Attached you will find the cancellation and the refund invoice.
