    Tracker boat was purchased in the amount of 18 k. Sales advised that boat was purchased and returned after 14 or so days because customer changed his mind. After purchase of tracker tried to go on the water Boat was unable to crank on two occasions. The only two times i tried to use it Returned boat to get fixed. They changed the ignition at which I found out that it was fixed in the past. Sales stated that nothing was wrong with the boat only a change of mind, not due to function to the function of boat. They did not inform me that boat was repaired in the past. Ignition part removed had tape around it, showing that it was repaired and did not come from factory in that condition. Also advised when purchased that boat was under warranty, which was not true, as they charged me to have boat repaired. Boat was with them for almost 2 or so months because they said they were backed up because staff had Covid. I am upset with the dishonesty of this staff, salesman that sold me the tracker is no longer with company. He presented the boat in perfect new like condition and with warranty....while company knew it was repaired.

    Business Response /* (1000, 5, 2022/08/11) */ Boat, engine and trailer was purchased on 01/03/2022 by Mr. *****. At that time, Mr. ***** signed a Warranty Disclaimer that clearly states that it was sold as is. I've attached it to this response. The bow to stern boat warranty expired 02/25/22 however Mr. ***** does have the remainder of the Mercury factory warranty on the engine only. If the problem existed when Mr. ***** purchased it and he would have brought it back before the warranty expired, we could have warrantied it through the manufacturer as long as it was not damage caused by the customer. Mr. ***** did not bring the boat to our service department until 07/05/2022 stating it would not start. We found that the ignition switch was damaged. The ignition switch is considered a boat component and not an engine component, which the boat warranty has expired. Also, with the switch being damaged, no warranty will cover that, it has to be a failure, not damage "if" the boat had remaining warranty. To help Mr. ***** out, we discounted the part price and paid half of the labor for him. The customer has had the boat for six months before he brought it back to us with this issue, so we feel discounting the part and paying half of the labor for the repair was more than fair and us going above and beyond to help. Berkeley Outdoors strives for customer satisfaction and in this scenario, we have done nothing wrong, we represented the boat at the time of sale properly and have the signed documentation to prove it. As far as the customers claim of a previous repair, I've searched our system and the previous owner never returned the boat to our location for any repairs before selling it to us and other than an inspection, no repairs were needed or made before selling it to Mr. *****.
