    We were in the process of purchasing a new build with Crescent Homes, later to be purchased by DreamFinder Homes. The process was drawn out because of litigation that came up with the surrounding community.

    The salesperson, Armando Solorana, repeatedly said the deposit to secure the lot/home would be refundable with a deduction of 1/3 for damages if anything were to fall through. At this time there was a lot of uncertainty due to the ongoing litigation with the permits.

    We moved forward and signed the contract with the thought if something changes we would be out 1/3 of our deposit and it was worth the risk for us.

    Long story short the process is drawn out because of all the delays. When we go to sell our home we did not recover nearly as much profit as we initially thought we would. My job also changed my pay structure which decreased my salary by over 10%.

    The day after our house sold we called Armando to discuss our options. He acknowledges that he mislead us on the refund of the deposit and backtracks by saying we have to look at the contract. I have a recording of this conversation. I could not figure out how to attach it.

    The sales manager, Brian Wagner, of DreamFinder homes becomes involved. He does not reach out to discuss the matter with us. He cancels our contract and informs us that they will be keeping the entire deposit of $48,000.00 for damages.

    They put the house on the market just a few days later. It sells for the same price that we would have purchased it for and it did not cause any delays in occupying the residence.

    DreamFinder Homes did not incur any damages, went back on their word. In my most recent email to Brian Wagner he also acknowledges the 1/3 deposit sales tactic used by Crescent Homes.

    They have a contract that we signed. They mislead us and I am sure we are not the only ones. I hope the BBB can help us get recoup our significant monetary damages.

    I attached a document that outlines the timeline of events to clarify.

    The purchaser of the home in question wrote the contract non-contingent even though he had a home to sell.  The sales person and the letter from the sales manager states that had he written the contract contingent on the sale of his home and his home did not sell then the seller would retain 1/3 of the deposit at the time of cancellation.  However, due to the contract no being contingent, there is no refund for cancellation.  In this case, even if the buyer had written the contract with a home to sell contingency, they would not have received the deposit back because as the buyer states in his complaint, he did in fact sell his home.  He states plainly that he decided to cancel because he didn't sell the home at the price he thought he would sell it for and because his employer changed his pay.  These are not things the seller can be responsible for and did not cause.  The buyer also says that part of the issue was a delayed build time but this in fact gave him more time to sell his home for the desired amount, not less.  The buyer contracted with the builder to build a home to their specifications and the builder kept  their end of the agreement spending hundreds of thousands of dollars to complete the home only to be told at completion that they no longer want to move forward and they want their deposit back.  The contract specifically says the deposit is non- refundable.  The seller is simply working within the confines of the purchase agreement and will not refund the non-refundable deposit as agreed to at time of purchase.
