    I received a termite bond of an 8 year term for $1000 from Mister Vaporizer LLC, owned by a Mr. Jared L***. I was notified that I was due for a termite inspection and pest control. The fee for the termite inspection is considered to be the annual renewal fee and is $130. I agreed to pay this and scheduled the inspection for last Friday. The following Thursday (yesterday) I emailed asking why nobody showed up. We didn't receive a call before hand, after, nor a note after their supposed inspection so I had no way of knowing if the came. Jared L*** responded accusing me of slander and denied to offer proof of work. I asked why I had not been billed to which I did not get a response. Instead, I received an email from Mr. L*** letting me know that he is voiding our contract because I haven't paid the renewal fee and that he can cancel the contract whenever he likes. I had still not been billed at this point or seen any proof that the inspection was done. I notified him that it would be in violation of our contract for him to do so as I had not received any form of invoice or bill. He immediately sent a bill but I don't know where our contract stands. I sent an email asking if he could confirm that our contract would be honored because I don't know if his statement of unilaterally voiding the contract still stands and he has not retracted it. I have not received a response. I fear that I am being scammed and I have little faith in Mr. L***s intent to uphold our contract. I am requesting that the BBB help me with this. A refund of the original bond payment as proportionate to the time that has not elapsed before the end of our agreement would be best. Otherwise, I seek a written/signed guarantee that our contract will be honored or a written/signed statement retracting Mr. L***s claim of voiding the contract. The invoice I received just hours ago is not due for a few weeks. Im hoping that this could be resolved before the payment is due so I am not getting scammed.

    Business Response /* (1000, 5, 2022/08/16) */ This client made false allegations against me and my staff. I tried to work with him to resolve this matter, but he continued to lie. He argued about the price stating that he was informed differently when the treatment was done. We provided proof of his signature which he acknowledges at first then says that it wasn't his. He makes comments that the transaction seems "shady", but he will continue to work with us. My tech arrived to perform the inspection and pc and nobody was home. My tech continued with the exterior inspection and then left. The client stated the we didn't show up. I explained that we did and that the tech noticed his camera on the front porch and he could look at that for reference. He never responded about the camera that would have shown proof of our presence. We performed the inspection on 8/5 and billed him on 8/8. We bill through Quickbooks and it shows the audit trail and shows that someone looked at the bill. This person has made false accusations throughout the process which I can prove with email, paperwork, and quickbooks. It was then that I informed him that we no longer would provide services for him. He continued to respond with email which we did not respond to. I have all the proof necessary if you want to see it. Consumer Response /* (3000, 7, 2022/08/19) */ (The consumer indicated he/she DID NOT accept the response from the business.) Mr. L***s statements are entirely false as the emails I sent prove. I made no false allegations and only viewed the bill after Mr. L*** stated that he will be defaulting on our contract. As mentioned in my initial message, I'd rather wait until I receive a retraction of his statement before paying him the "renewal fee" as it is not due yet. I initially assumed nobody had showed because I received no indication of any kind nor a bill until after I expressed that this would be tough for me to reschedule and was subsequently notified that they did show. I never claimed that my signature was not on the contract. That part is completely false though it is factually not my or my wife's writing. I have made no false allegations and have not refused payment. I accepted that they did show immediately after being told. I assumed they didn't show because nobody had gained entry as they had in previous times and I had no indication that they did. The only false statement within our original correspondence was Mr. L*** claiming nobody was home. My wife was home. I have violated no part of the contract and made no false allegations. I expect Mr. L*** to retract his statement constituting unilateral default of our contract or forfeit the initial payment of $1000 in an amount proportionate to the time that has not elapsed on our contract. I have another question for Mr. L***, what did you see on the termite inspection? Did you find something and that's why you are attempting to default? Am I to receive any indication of what was found or not found during the inspection? Business Response /* (4000, 10, 2022/08/26) */ I have an email thread that will show Mr. ****** making false accusations. These accusations include the following, and I am paraphrasing: Mr. ****** wasn't aware of the yearly fee, but he did sign the paperwork. What he has doesn't constitute a contract according to him. We didn't show up for our appointment. The truth is there is a yearly fee on all termite bonds. The way a termite bond works is the initial fee of $1000 in this case was for the termite treatment only. The additional $130 per year pays for the insurance I carry on that house and our time spent for the inspection. It is standard industry practice. He did sign that paperwork which we have on file and we sent to him which he now acknowledges is his signature. We also did show up for his inspection and to do his pest control. I can't say if no-one was home, but no body answered the door. I have stated twice that my tech noticed a camera on the front of the house and asked that Mr. ****** look at that for proof which he has not answered to this point. I also have proof that we sent him an emailed bill for this inspection on 8/8/22 at 11:49 am and that someone on the other end of that email viewed it on 8/8/22 at 4:27 pm. We use quickbooks and it details an audit trail just for this occasion. On 8/11/22 was when Mr. ****** emailed stating that nobody showed up. Then in an email on 8/12/22 at 9:07 am he states "I received a bill just now. How convenient!?". Again he made a false allegation as the quickbooks audit trail clearly shows that someone in that household viewed our bill on 8/8/22. He also was rude in the same email thread stating "Thanks for the headache that no other pest control company gives people. You've been shockingly unprofessional and unresponsive to my questions". However I was answering his questions which are clearly visible within the email thread. On 8/12/22 he wrote "you can't claim I haven't paid without billing me. I haven't received any invoice and wasn't even notified of work completed". And again quickbooks shows an audit trail of someone within that household viewing the emailed bill on 8/8/22. My stance at this time is that I wish to not work with Mr. ******. His termite treatment was paid for, he would only owe $130 at this point for the continued bond. He can keep that money and we can part ways. I have proven and still have all the proof of him claiming false allegations on an email thread which I have shared some of that here. Consumer Response /* (4200, 12, 2022/08/30) */ (The consumer indicated he/she DID NOT accept the response from the business.) I'm not sure why Mr. L*** is fixated on my cameras or signature. I never once claimed that it was not my signature. I never once claimed that what I was sent did not constitute a contract. I don't care to rebut Mr. L***s irrelevant claims and blatant lies. I also did not receive or view a bill until the 12th. How could I without receiving it? Either way, I never got any form of inspection. Mr. L*** refuses to disclose any findings, so as far as I am concerned, the inspection is still incomplete. I suspect that Mr. L*** may have found something and is unilaterally defaulting on our contract because of this. I never received an inspection and Mr. L*** defaulted on our contract before billing me. I also suspect that Mr. L*** tampered with the quickbooks to show the bill as being viewed before sending it to me (if it does reflect someone viewing before the 12th) in order to make it look as if I refused to pay. There is no login so anyone could mark the bill as viewed before sending it. I would have assumed that someone did come for the inspection if I received a bill. In any case, I am well within my rights to advertise that Mr. L*** and his LLC known as Mr. Vaporizer defaulted on a bilateral agreement. Don't be surprised if your zip code has some unusual youtube ads warning about Mr. Vaporizer's unethical business practices and likelihood of default.
