Initial consult in April 2024. The business was to remove a small sidewalk that led to our back door and pour a large concrete pad for my back patio. Emphasis was placed in conversation with the man that Mr. ******** sent to do the job, that water would pool in the area entering the mudroom. It not only increased the mosquitoes getting into the house but was also a safety issue as I was recovering from multiple spinal surgeries, and my husband was preparing for knee surgery. I was ensured that the completed job would take care of pooling issues with a level slab. I was ensured that there was nothing that would be an issue (tree roots) that would cause additional pooling on the completed slab. Not only does the water pool in the exact same area that it had before, it pools worse there with additional pooling overall. I have contacted Mr. ******** several times. He has come out to the area and has sent the man back out to also view the area. I contacted Mr. ******** as to why nothing was being done after coming to view the incorrectly poured pad and initially was told it would be about 2 weeks. When that didn't happen and I contacted him again I was told that the concrete guy hadn't had many jobs recently so he wasn't able to purchase the materials for the job. Mr. ******** then stated that the that the concrete guy had an upcoming job that would make it possible for him to come and fix our pad, and asked us to give him another week or so. I messaged Mr. ******** again and explained that we had made the deal with him to. do this job and he sent someone out that did the job incorrectly. He is responsible as the hired contractor for the job. I explained that he did not have to wait to be paid for the job once it was completed and that I really wanted to keep this on a friendly, professional level without outside intervention. He responded that he understood and would have someone out by the end of the week. Never happened and additional message to him has been ignored.

    Business Response

This job was performed by a third party that we hired to do the work. They are the only party who has the material and knowledge to make the repair. We are making every effort to have them make the necessary repairs but due to issues on their part have had repeated delays. We are continuing to seek resolution from them and do guarantee some resolution as soon as possible. I we had the ability to handle it another way we would. This job was done as a courtesy to a neighbor and we simply passed the job through our business at cost and did not charge more than our costs on the job which included it being covered under our insurance. No profit was made. We will continue to seek resolution and have assurances from the subcontractor that he will make the job right. We have performed other jobs for this customer that were done directly by us with no complaints and all fully guaranteed. We will continue to pursue remedy in this case to the best of our ability.

I am rejecting this response because: As in the initial messages, Mr. ******** stated that he would have someone to my house that week one way or another. It never happened, nor did he even bother to respond to the next message I sent to him. I am sorry for the difficulty the man he sent out is having but that is not a problem of ours. We have done our share of this deal. We had the whole area cleared and prepared as asked when the concrete man came. Mr. ******** was promptly paid for the job as I presume his representative was when he completed the job. The concrete man is as much a direct representative of Mr. ******** and his business as Mr. ******** himself. The job needs to be redone and we should not be having to wait and suffer with the consequences of poorly done work by his representatives, as he did not wait to be paid. I want to work this out but the water draws bugs and it isn't safe. If it were my company I would have already sent someone else out to redo the job and then recoup from the initial worker myself. That is the correct way to handle it especially knowing that the work done has left the patio with multiple areas of sloping, which can cause someone to fall. The job, his job, was done incorrectly. I certainly think he would be as displeased as I am if someone was doing this to him.

    Sincerely,

    Kim C
