We signed a contract with Cindy E*****'s at Showroom Portal Buildings in Sept 2024 for a ** * ** ft metal shop building. We contacted her first of January that our site was ready for construction. We did not hear any updates from her until I called her to inquire about adding insulation instillation to our contract. She stated that would be not problem and updated our contract to reflect the change. I gave her the required 17% deposit for the insulation on that date. Cindy mailed the updated contract for a signature. We promptly signed it and returned it in her pre-addressed envelope. The crew finally from *** ** *** **** ********s arrived on March 10 in a thunderstorm. They came back the following day and completed the building about 8:30 that evening. When my husband arrived from work to inspect the building and pay the balance, he found that no insulation had been installed. The non-English speaking crew got someone on the phone and my husband called Cindy. The building company stated they did not have the updated contract and Cindy stated (oops) when she checked after my hubby called she discovered that the update did not go through when she sent it 6 weeks prior. We have been trying to work Cindy and *** but now they are not answering our calls or responding to messages.

    Good afternoon.

I did sign a contract with *** and the *******'s in 09/2024. We did discuss insulation, and they did decline at that time. In late January 2025 they did reach out to say they were ready to be put on schedule. I did reach out to *** to have them put on schedule. Before install the *******'s did reach out to me to say they would like to add insulation and did do the deposit on the insulation. I sent over a contract for them to sign and when I received it, I did attempt to forward over to *** and there was an error in the system and the email did not make it to ***.  *** did call and schedule and review the order to install and as always did request for customer to be on sight. The *******'s were unable to do this and requested *** go ahead and start building. The building was installed but not the insulation due to the fact *** did not receive the change. I did fully refund the *******'s for the deposit of the insulation directly back to their card and made them aware.  I did call *** and work with several people there to see if anything could be done. *** did offer several options of different types of insulation that would work after building was up and that the company would make sure that the options on insulation would be at the same if not better cost.  Once the building is installed certain insulation being added could compromise the building, so other safer options were offered but rejected.  The original building that was order was completed and paid for. They did want to make a last-minute change that was unable to happen as they requested.  The company has offed alternatives and money has been refunded.

My company, Showroom Buildings does sell steel building for ***. I am paid a commission on what I sell to them. The *******'s have not paid for anything they have not received and were offered several options by *** but refused.

On 7/8/2024, Cindy E****** from Showroom Portable Buildings LLC came to our house to give a quote on a 36” X 30” 2 Bay garage for my 82-year-old father-in-law. She was very inappropriately dressed in a white vest w/ no shirt & short denim shorts. She told my father-in-law that there was a sale ending that day, & that if he wanted the discount & sale price, he needed to sign & put a deposit of $1,646.41 immediately.
He agreed, paying w/ Check ***** in the amount of $1650.00, dated 7/8/24, making it Cindy personally. Due to extenuating circumstances, the building permit was denied. When my father-in-law contacted Cindy & explained this, she stated that she would try to see if she could refund the deposit. After a week of no contact, my father-in-law called Cindy. After a brief conversation, she stated that she could not refund his money. She offered to put that money as a credit toward another purchase. My father-in-law stated that using the money as a credit would not work.
On 3/7/25, I called Cindy to see if we could come up with a solution. She became very defensive towards me & stated that she could not refund the money due to several trips made to our house, paying several people to work on the project, & that she made an exception when she came to give the quote as they normally do not go to prospective client’s home. When I told her to please calm down as she sounded very defensive towards me, she stated that she was not being defensive, that she had stepped out of her office as she had several people in her office & that I was being defensive. She then stated that when I calmed down, I could call her back. She then proceeded to hang up on me. When I called her back 5 minutes later, I stated that we needed to start over. She kept saying the same thing over & over - that she was not going to refund the money. I know that she was lying - there was ONLY 1 VISIT to our house & house calls for quotes are common.
My question - Where is the $1650?

I did go to *** ****** home at his request to sell him a steel barn at his request. I did have to go after my regular business hours because I could not leave the office during business hours. I never one time spoke or seen ******* ******. I am very unsure how she would be so precise on what I wore that day but i can assure you I would not have dressed inappropriate.  Her father-in-law that she speaks of did want to purchase the building because they did have him living in a camper in the back yard. I did also send a guy to measure for concrete at his request as well. The contract does state no refund on deposit. *** ****** did give me a call and said he had decided to build a different type of building..  I did remind him there is no refund. He did say he may need a portable building because they had sold his to make room for the building they were looking to build. I did tell him I would give him some discount and some credit toward a portable building to help him out since we do not do refunds. He said he would get back with me.  A few months later ******* called and said she wanted a refund and would not allow me to speak. I did tell her when she would allow me to speak to call me back and I would explain to her as I had explained to him.  She did call back and after we spoke, she said (he did not explain this to her) on how that was, and she thank me, and I did not hear from her again. She did reach out to my builder, and they sent me over the email. My builder was aware of the signed contract that he signed that does say no refund on deposit.   I have never done business with ******* ****** and again she was not present at the time of purchase.
