    I made a purchase from this vendor for what was supposed to be $652, the amount is shown on the sales ticket. I paid for it with my Bank Of America Visa Debit card. The next day I saw in my bank account that they had actually charged me $671.56 for the sale. I looked back at the small receipt from the card reader machine they used and it showed a 3% charge of $19.56 for using my debit card. I was not told about that prior to them running it, and furthermore that is a violation of the Durbin Amendment of the Dodd-Frank Wall Street Reform and Consumer Protection Act. That law says vendors can not charge the consumer for using a debit card, even if the vendor ran it as a credit transaction. The transaction came out of my account right then, just like cash. I contacted the vendor and asked him to refund the charge and he refused. He said the card company added that to the sale for processing it. If that is so, then that company violated the law as well and you need to cause both to cease and desist with this illegal practice. The card company that provided that reader to that vendor should have charged him 21 cents plus .0005 x 652 or 54 cents. Someone is lying or has a racquet going and it needs to stop. Please let me know what the outcome of this complaint is. This is not honest legal business practice. I also filed a complaint with the CFPB and they had BOA issue me the refund, but I want the vendor stopped as well.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint. 

    Their sign does not give them the right to break a federal law prohibiting charging a fee of any type for using a debit card, or trying in any way to circumvent that law.  They are breaking the law.  Refer to Durbin amendment of the Dodd-Frank act.  A BOA Visa Debit card was used.  When I filed a complaint with the Consumer Financial Protection Board, Visa contacted me within hours and refunded the illegal charge, and apologized.  BBB can do whatever you want, but if you allow such illegal practices, then you too are culpable.
