  On Wednesday Sept.6,2023. at aprox 5:14am at Comer Distribution facility. Located ,**************************************************** ********* ** *****. I rolled over a very sharp medal rail. & it punctured 2 outer tires on the driver side. The sharp object was not properly concealed by The traffic drum. The sharp object was not in plain view due to a traffic drum that wasnt properly placed next to it. Im respectfully seeking compensation for expenses for installation and replacement of my 2 tires in the amount of ******.

  Comer Distrtibuting has been in business for over 50 years.  If we were at fault in any way, we would absolutely pay for repairs.  However, we have reviewed the video of the event, walked the property in question, and we have determined that Comer Distributing Company has no responsibility in this case.  When a commercial truck driver backs into a stationary object, fails to Get Out And Look (G.O.A.L) which is basic driver training, continues to back their trailer further and further over an obstacle until the vehicle bucks under the strain, the driver is 100% at fault.  We have 30 to 50 deliveries weekly and have never had an incident like this before.  The object in question, a 30 foot I-Beam was not located in the dock ramp at all, but in a pallet storage area.  The driver backed the trailer into the pallet storage area, not into the dock ramp.  The beam was marked with a large orange construction barrel.  I understand the driver's frustration at the situation, but just like running over a curb, or backing into another trailer, the only fault here is driver error.  We will not pay for any repairs.

  I am rejecting this response because:
  I have information of drivers that this has happened to from another driver.  That will be summons on our behalf. Once again they are not being honest. And driver did GOAL. Way before both drivers got in door ,its on video. That business is not warning drivers of their hazardous environment.  I need their legal address for court reasons. I asked them this through email and got no response about it. So again can we please have your legal address and the legal Representative name to send documents to.  Thank you for your time.

  I have reviewed the response made by the business in reference to my complaint, and find that this resolution is not satisfactory but I appreciate the response because. I  have the address to send court documents to. Not satisfied with the way they handle business at all.
