    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. 


    No lease was sent to us to review. We did not sign any agreement saying that we would be moving forward with the home. A text message is not a binding legal document. According to the SC Statute of Fraud, a year long lease must have a written signature and must be fulfilled to keep the security deposit. We gave money as a way to save the home, yes, but within 24 hours decided the home was not for us. The house is still on the market and has had over 100 people reach out to Friddle Property Management. No where in writing does it say that you can keep the money that was given to hold the home. There is no legal grounds for the company to keep it. Again, the only piece of paper that was signed by us was the application. Word of mouth while touring the home is not a legal and binding agreement. Texts are not legal binding agreements. The property management company has the opportunity to make the money back from allowing any other person to rent it that falls within their application criteria.

    You stated yourself if you read in the text below that you gave the security deposit “to secure the home for us”. 

    I also want to note when we walked through the property together, you understood that we were going to do our best to have this home ready by June 1, 2023, yet  we could not promise that. You stated that that was OK. We tell everyone that once we receive a security deposit it’s nonrefundable if you change your mind. We also state, if you’re not certain about a property do not follow through with it. This was all discussed when we showed you the house. Our texting thread is below as proof, that you agreed to accept the property and sent the security deposit willingly

    We were under the impression that the lease would start the first of June. Upon further discussion, we have come to the conclusion that this house is not for us. We know you'll have an easy time renting it out. We would like to get our security deposit back so that you can proceed with other renters. We thank you so much for all of your time and effort.

    Good morning! We discussed this whenever we showed the house to you and I stated that we would do our best to have it ready by June 1 and we will.  our policy is , once we take a home off the market and secured the security deposit, it is nonrefundable just because you change your mind. Of course the deposit is refundable once you move out and leave the home the way you found it. If we are able to secure a new tenant between now and 1 June, then will be happy to give you the deposit back otherwise it’ll go towards the days in which you’re not there in June until. Thank you for your understanding.

    We'd also like to know when we can expect our deposit to be refunded due to the fact that we never signed a lease and only completed the application.

    So based on your rental application terms, there's nothing that says you get to keep our deposit. We did this as a way to secure the home for us, but we determined it isn't for us. There's nothing that we signed off on that says you can keep it. We would like to see where we agreed to this. We just need clarification

    We certainly do not want to be difficult and not trying to be difficult at all. However, when showing you the property and through our thread of text, I asked if you wanted to move forward with this property and you said you wanted to move forward and sent the security deposit. You then changed your mind. That does not mean you get to get your deposit back. We had to take the Home off the market and then put it back on the market. That is why we do not return security deposits if someone just changes their mind. Thank you for your understanding.
