      Concrete foundation eroding exposed pvc pipe and rebar. Numerous drywall issues, a few doors weren’t installed correctly don’t shut or line up, drainage issues, sprinklers put in neighbors property, outdoor trim warping coming off house, etc Sent multiple emails to warranty and their legal representative as instructed with no response from either party. Company normally corrects minor issues but has currently failed to honor contract any longer or set 11 month appointment. Just want the company to correct the issues on this new home.

      Daniel, Thanks for reaching out regarding
      this customer. As you know, we take every complaint seriously.
      Mr. ****** closed in July of 2024. At
      that time, there were no concerns with the grade or foundation in our internal
      inspections, as noted by the customer when they did their two walks, or by the
      building inspector. In September 2024, we went through our typical 90-day
      warranty process with Mr. ******. We addressed some minor grading issues he had
      with water by his driveway. When we finished, he was happy except for the
      normal drywall imperfections that arise from the house settling, we explained
      that we would take care of it at the 11th-month warranty follow-up to
      allow the house to settle through all four se****s fully.
      Before we got to the 11th-month warranty
      follow-up, the manhole issue further worsened his attitude towards pursuing a
      solution, as we informed him that this is not in our scope. Rather, it’s a
      community issue that the declarant of the HOA needed to resolve. Earlier
      this year, Mr. ****** informed us that he would seek legal action against us.
      It is company policy that once someone threatens legal counsel, we will
      defer further communication to our attorney, to whom we provided their contact
      information. To our knowledge, Mr. ****** has not been in contact with the
      attorney we provided contact information for, but he has contacted the closing
      attorney.
      We are certainly available and willing
      to correct any warrantable issues within our scope of work, as well as help
      guide him to appropriate solutions for those items outside our scope of work.

      We bought our house in September of last year, when purchasing we were told flooding would not be an issue (we toured the house on a rainy day and noticed some) and that water should move down the lots into the retention ponds. Since we have entered a rainier season the water retention in the yard has been an eye sore, leaving us with no option for backyard furniture, is riding up the neighbor fences which will eventually lead to wood rot and has also created a big hole where our septic tank is. When reaching out to warranty since we are still within the year of buying, someone came out, we sent photos and eventually were told there was nothing they can do. My neighbor who also had the same issue had their property fixed free of charge by McGuinn homes so in reality there is something they can do but are choosing not to. When I emailed them back explaining how this is unacceptable and asked for some kind of effort/solution no one ever replied back to that email. I have called the warranty department office, and no one ever picks up the phone, when the answering machine comes on they even say to not leave a message as they do not listen to them. I am tired of not being able to put anything in my yard in fear of it being underwater then it rains. We want to enjoy our yard and property that we paid for. This builder has a history on drainage issues with many constructions sites. Even though the builder has added French drains to my neighbors yard they are still having issues along the line where out lot meets theirs, that's how bad the flooding gets on heavy rain days.

      Joel our warranty manager, was at your home Monday April 22, 2024, in the afternoon to assess the yard from the rain Sunday April 21, 2024. As the pictures show, the rain was gone by 48 hours after a rain and 72 hours.
