    We hired ***** ******, Nustad Construction for structural reinforcement of our home. We paid $37,290 down on an estimate of $58,090 4/10/23. Issues encountered in the work so far include:
    1. The columns and beam installed in the north foundation wall of the basement are too far south and need to be moved to the north ~3". One of the columns isn't fastened properly; the plans state it must be fixed to the floor with at least 3 bolts, and he only used 2 bolts in the west column.
    2. He installed 3 footings for columns. After receiving more assistance with measuring, we learned that all 3 are incorrectly placed and need to be torn out for installation new footings. When I spoke with ***** on 2/19/24, he stated the incorrect footing was wrong on the engineer's plans. ***** ************* project plans state that it is the responsibility of the contractor to confirm all measurements; he didn't confirm measurements or follow their plans.
    3. The steel ordered and fabricated by *** is wrong. He signed off on the revised shop drawings (which had support beams on top of floor joists instead of under them) on 6/26/2023, and fabrication began the next day. He signed for the steel when it was delivered without checking it against any plans or list.
    4. We have a hole in our 100+ year old hardwood floor and a broken basement storm window caused by *****.
    I spoke with ***** on 2/19/24 and said we had reservations about him completing the project; after thinking about it and discussing it with his son, he agreed it would be best to part ways. He also indicated he would be keeping all of the money paid to cover labor, materials, and fuel (NB fuel was not included in the estimate). The cost of the steel was $20,557; we don't know the other costs since he will not provide an invoice that I requested on 2/19/24.

    I received a copy of the invoice directly from *** ******. We would still like to pursue a refund due to our having to re-do the incorrect work. Is it OK to discuss this directly with him or should we wait to hear from you at the end of two weeks?
