    Earlier this year, my roommates and I signed a lease for the 23-24 school year to rent a four bedroom apartment in Brookings, SD, through Mills Property Management. Eventually we ended up being approved for a different apartment, so we quickly signed the early lease termination form. We were told that signing this form meant we would only be responsible for the rent each month until someone else rented the apartment. We were also told that we were welcome to advertise the availability, which we did through ******** market place. Through ******** we found a group who was willing to take our apartment starting August 4th (the first day of the lease). We went through all the necessary steps, ensuring the group passed the background check and filled out the application. When the group went to select our apartment number, it was not listed. They contacted to property manager to ask specifically about taking our apartment unit, and they were redirected to a different apartment in the building. This took place on 5/18/2023. In the early lease termination it is written that the "date I would be moved out of the townhome/apartment and able to do a walkthrough with Mills Property Management 4/30/2023, (townhome/apartment will be marketed for occupancy two weeks after this date)." Mills Property Management did not make our apartment available by the date stated in the early lease termination. The group who would have taken our apartment had to lease a different unit, and now my roommates and I are still financially responsible for our unit. I have attached several images of the conversation with the group who was planning to take our unit, as well as the early lease termination form.

    Unfortunately, once a unit is released (request for early termination received), our software system takes 24 hours for the unit to show up on our online portal for an applicant to select. This was the case for the applicants who wanted to secure Ms. ******** unit as we received the early request termination on the 17th from them, and the new applicant messaged the manager on the 18th inquiring about the unit.  While we have no control if the applicant chose another unit online, we are more than happy to work with Ms. ****** and release her and the other co-applicants from further responsibility regardless.  Our Regional Supervisor, ******* ********, will be reaching out to Ms ****** to advise of this information.  We would have appreciated communication directly with us to resolve this concern of Ms. ******, to which we believe we have met the desired settlement.
