This rental company is withholding my full deposit of $2025 illegally.
I gave the required 45 day notice per the lease and prorated the rent. The owner told me that I owed 60 days rent because "prorating isn't how it works." The lease only required 45 days.
They sent me an itemized list of deductions from the security deposit within the correct time frame. The correct deductions came to a total of $450 dollars. They attempted to charge the remaining money on the grounds that I clogged the sewer with feminine products. I disclosed medical information that proved it was not possible. They did not return the rest of my deposit.
Two days after the legal timeframe, they responded saying they washed what was pulled from the sewer and it was not feminine products. I did not hear from them again until November 1st, which was two weeks past the requirement for returning my remaining deposit. They sent me a new list with malicious charges including a fee to remove lint off the dryer screen and smoke detector batteries. Not only are they claiming I did the full $2025 worth of damages, they tacked on an additional $75 dollars. I attempted to dispute the charges and negotiate the deposit stating South Dakota laws and renter's rights. He called the law and renter's rights my opinion and told me to take him to court.

This man illegally entered my residence atleast once without notifying me that he was entering. As well as asked on multiple occasions to " stop by" without proper notice.
He attempted to charged me for plumbing issues because I am a woman of childbearing age. He did so with no evidence. I have a person willing to come forward to share her experience in another one of his properties. He accused her of clogging the pipes as well. He had to drop it once she proved, it wasn't feminine products.

He is illegally withholding my deposit.

I did not tell her anything about 60 days. The 45 day notice tells us you will be out by the end of the next month. The renter decided to pro rate the last month of occupancy without any consent to only paying until the 25. When you pay rent for the month it is for the full month. We were not going to argue with her until She ended up staying till the 31st anyway and didn’t pay and that’s when the late fee came in.

the Notice was given on the 11 and within the proper time frame of 14 days. she was told she would not be receiving ANY of her deposit. She asked for a detailed list and the law says we have 45 days to provide it, so no laws were violated. We had several other reason beyond the sewer to make the expenses that she is not telling you about.

in the lease it says there will be a $675  fee if we have to clean up after the renter and the broken window and glass on the carpet upstairs is something she neglected to mention ..among other things ,details are in the only photo I could upload at this time.

we were told by our plumber that the cause was feminine products, she disputed these claims and I investigated further and dug through the sewer debris by hand and agreed with her that it was tree root .

the 75 $ dollar charge was for a garage door opener and the batteries for all the smoke alarms that she removed.

the 100$ dollar charge was for 5  window blinds to be replaced.. I have all the text messages to prove my side of things and that i never entered the property without prior notice or approval from tenet to fix a leak in the roof, at no time while they were living there did I go over for an inspection or any other reason
