    On November 8 Hovey construction started inground pool construction the contract contract paperwork was signed on 9/6/2022 contract stated they would commence on or about Summer or Fall of 2022 they broke ground on 11/9/2022. The contract had to be redone 3 time because the sales person kept leaving things be discussed out, 2 steps up to the pool deck was one which never got put contract. Cost on the contract was ******* loan was for ******* through **************. Const go to the concrete and I had asked about adding extra on North and East side of pool since they only provide 4ft around pool Met with **** talked about it and he said he would send me an addendum I waited I texted him but never got it. On may 31 I checked camera and there was a concrete truck in yard pouring. Next thing I am receiving a final statement for ********* for extra concrete, the stairs which should have been on the loan and the electrical work. I contacted them and was told she would talk to **** and get back to be. Week or so later I get email from lawyer saying if not paid **** would be placed I never signed for extra concrete and if I would have had the chance to see the addendum quote I would have adjusted amount to a more suitable cost (less concrete). The extra concrete was $6000 for around the pool and charged $3000 for the steps which were not done the way I wanted. On contra it clearly say shallow end steps provided by builder

    We had a contract that was to commence in the Fall of 2022, which it did. While the contract was signed on 9-6-22, we weren't cleared to start construction until 10-12-22. After we received it, we worked them back into the schedule as we didn't have a crew waiting on standby ready to go if and when we got the go ahead from THEIR lender. I have attached the email showing this. Also in this email, you can see that HIS loan amount is only for $100,000 and that HIS out-of-pocket expense is for $3,215, which he still fails to acknowledge. We proceeded with the pool install until we were shut down due to winter conditions. And if we are being technical about breaching contract terms, he is very much in breach in the part that states they cant swim until final payment is received.

    For the concrete, I met with **** in early May sometime to discuss the pool decking. He indicated that he wanted enough space on the deep end to accommodate a hot tub and that he wanted 8' on the east side to accommodate loungers, so I had the concrete subs proceed. The decking was formed up and ready for concrete for more than a week before they poured. I was never asked how much the additional concrete would be and didn't talk about and addendum being done. We proceeded as he directed us to. And as I have discussed repeatedly about steps, there is not steps included in the contract. The steps he is referring to are the steps inside of the pool, referring to the 2 corner steps down to the tanning ledge and the full-length steps from the tanning ledge down to the deep. While the concrete steps are nice, I told him we would just do a sidewalk ramp. **** is the one that told the concrete sub to proceed with concrete steps that we charged the additional to, which is just me passing on the costs that we were charged. 

    This is only a complaint because he doesn't have the money to pay which we have now taken legal action.
