Moved into the property in 2021. Multiple things have needed to be fixed since then, but have not been. I have re-addressed the issue(front door has huge gap underneath causing outside elements to come inside as times) at some point last year. We have been on the "maintenance list" since the. In the past our fridge quit working and it too 2 weeks to get a new one!! They never come in a timely fashion. Everything in this house is rigged up one way or another. When they have "fixed" things it's never correctly done only half-a$$. I'm tired of asking them for maintenance issues and them never following through. Sometimes I won't even get a response at all so I'll have to ask again. It's frustrating and I'm fed up.Business Response

Good morning, we have been to this home several times for AC at least two times last year in 2024 (HVAC company told us tenants dogs chewed threw the wires)
2025 water heater replaced, water heater was leaking March 28 fixed.
Tenant did a service request one time for the door, see attached, it's been assigned to a member of maintenance.
I have worked with these tenants for several years on maintenance, late rent, numerous NSF's, and most recently the discussion of downsizing.
I have contacted the maintenance person to expedite the tenant's request.

Moved out **** ** ******* ***
Sioux Falls, SD 57704 on Dec 05 on account gang violence.
End Dec 2024, spoke phone *** at Chaks Properties Management to let them know moved out of apartment, and she agreed to refund prorated rent.
I lost access to Chase Bank account while in Hawaii. Early this month, moved Kansas City, MO where reopened Chase Bank that had ACH withdrawals $1050 per month.
Later, notified Chaks Properties Management didn't receive the rental refund.
I think Chaks and **** ******** ********** ******* owes me over $4,000. *** agreed via email that would send refund amount to me via normal mail.
Please help me resolve this financial situation.Business Response

Good morning, **** signed a one year lease with us (see attached) He did not give proper notice to vacate. He left the state sometime in December of 2024 and called us from another state stating he left.
The lease was set to expire August 31, 2025. **** recently contacted us regarding the ACH payments that were being deducted from the original account information he provided us when he moved in 8/1/24, that is the only bank information we have had, what he provided us.
We offered **** to refund the money to the account it was taken from, he told us that account was closed. We then offered to send **** a check. **** provided us with 2 different address to send the check, one in Utah and the other in Nevada. For the protection of ****, we have not mailed said check as we need to confirm he will not need to change addresses again.
Our accounting department is looking into why they funds remained to be deducted from his account without notification of the account being closed. Things just don't add up. If the account was in fact closed-the funds would not be able to be deducted, therefore we need to confirm before issuing his refund.
We have spoke with **** several times about this.

I called ***** ******** January 23rd and today(2-3-2025) concerning this matter and have yet to receive a call back.
This was filled last year in 2024 and BBB sent letters that the Post Office could not deliver because of wrong address. They sent the letters to ****** ***** **** **** **** ** Huron South Dakota 57350 and the Post Office would not deliver them here - this is my address.

***** told me she needed an authorization for me **** ****** to represent my Brother ****** in case ID ******** against Chaks. The last I spoke to ****** he had sent the authorization to BBB.
Please do something about this. I've spent a lot of time trying to get this corrected

Dear Sirs, hope you all had a great Christmas/New Years;
On 12-21-2024 my mail carrier, whom I grew up two miles from, rang my doorbell asking; “What should I do with this?” It was your 12-13-2024 letter in response to my letter 12-6-2024 complaint; however it was addressed to ****** ***** **** **** **** ** ** Huron SD 57350 having a yellow label saying [UNABLE TO FORWARD / FOR REVIEW]. I wondered how this company out of Omaha Ne. had coupled my brother’s name with my address[his address being Carpenter SD, but is now in jail]. I did not associate BBB with the Better Business Bureau while standing at the door with him. After a blinding flash of the obvious, I opened it, went to the library, and going to the Better Business Bureau web site accessed (Complaint ID: ********) finding it had already closed the day before ****** my carrier, gave me the letter.

Hello, in regards to ****** ***** and his security deposit refund. His brother contacted me and gave me his address to send all correspondence. Attached is his letter that was sent to his brother's address explaining there is no refund.
This was also explained his to brother's. We require a 30 day notice to vacate, due to ******** criminal actions and history he was incarcerated and no notice was given therefore leading to no deposit refund.

I am rejecting this response because: Chaks was notified that I **** ****** had moved ******** belonging out, cleaned it immaculately, and it was ready to show. There are only three reasons for non-refund of security deposit; repair to unit, payment of unpaid rent, or cleaning expenses. NONE of these apply.****** accepted my communications saying, "tomorrow I will be in Huron and inspect the unit."
It looks as though Chaks is a parasite seeing "security deposits" as "free money". I'm sure you would be irate if a relative of yours was treated in like fashion.
Step up to the plate and act as those who are human. This man is sick.
Only 41% of renters receive all their security deposit back. What is your percentage of refund?

I had given notice to ****** we would be moving ****** out by the end of September and have 475 20th St SE #101 prepared so ****** could get his $250.00 damage deposit back. On September 20th at 12:55 pm I sent the following text to ******;

One minute later, at 12:56 pm I called and let her know of the text I had sent and asked her to make the check out to ****** and to send it to me at **** ********* **** ** *****
I told her I helped ****** move in and that there was a large area of the bathroom ceiling that had caved in from a water leak and there was sheet-rock all over the floor, in the tub, in the toilet, and sink. ****** fixed the ceiling, sanded the rust from the bathroom cabinet and painted it and the ceiling. There was a drawer in the kitchen that was laying on the floor in pieces ~ he repaired it also. I told her we were leaving the blinds.
I tried calling ****** on September 26th at 11:07 am and left a message, on September 27th at 10:30 am leaving a message, and September 30th at 11:35 am, once again leaving a message that I had moved to **** **** *** ** ** Huron, SD 57350-3800 and asked her to send the $250.00 check to my new address.
Later, I told **** I cannot get a call back from ****** and asked if he happened to go by there, and if he saw her car, he would talk to her.
After making contact, **** told me that ****** said that ****** had caused a lot of trouble and that Chaks was not going to refund ******’s damage deposit.
There are three reasons a security deposit may be withheld: to pay for damage to property, cleaning expenses, and unpaid rent. "****** said that ****** had caused a lot of trouble and that Chaks was not going to refund ******’s damage deposit" This is illegal retention of the security deposit.
****** accepted my announcement of ******** vacancy. !

****** has not worked with Chaks Properties since May 2024. We are not in the business of keeping deposits, we are in the business of following policy and procedures which was accurate for this situation.
There will be no refund and no further communication with *** ***** regarding this matter. *** was not a tenant nor was he listed on the lease and has no legal right to ******** security deposit refund in the event there was one.

I moved into home 11/14 and we had issues with home right away. Contacted property maintenance company asap and today which is 61 days nothing has been fixed and it includes issues like leak in basement , mold, foundation issues, furniture left outside by previous residents, window broke, leaks in bathe room. And now Jan 3rd my rent came out of shecking ach payment not posted to rental account and this is ridiculous can’t reach anyone. Any live in my basement.
