Contracted with Allied Construction to remove the old roof and install a new roof on the house. The work was done in October 2022. Total estimate $*********. I have paid $*********. Allied states that “it prides itself on delivering 100% customer satisfaction”. The quality of Allied’s subcontractor’s work was satisfactory in that I got the roof on before winter hit, but there were several mistakes in the installation of the roof - some were corrected, others it was decided not to try to correct. My biggest complaint is that Allied ordered an excess amount of roofing materials that need to be returned to the distributor. One example: the contractor ordered four pallets of shingles and only three were used. That is a 33% overage on just the shingles, not including all the other items that were ordered to install the roof (i.e. ice & water, valley metal, nails, vents, etc.). The distributor wants a restocking and pick up fee for the excess roofing materials, all at the customer’s cost. The manufacturer, distributor and contractor have all made a percentage of profit on this order and the excess roofing materials. (Could this be a scam of some sort?) I have tried to get an understanding of what the charges were for materials and labor but the answers have been very vague. The original quote for the roof was $*********, but the contractor said there was a **% price increase after my initial contact with them. What I would like is satisfactory price reduction for the excess materials and labor to install the excess roofing, written proof that the subcontractors and suppliers were paid, and a written warranty for labor, materials and workmanship, as well as who will honor the warranty. I believe Allied is a reputable organization, I need assistance in resolving this matter.

    Good morning-

Thank you for allowing us to respond to Mrs.
    ******* complaint.
This home has a very tall and steep roof. The
only way to safely determine the amount of roofing materials required is
through a satellite  measurement of the
structure. ***** ****, and ****** ******* are just a few of the hundreds of
companies that offer this service to contractors. This type of service is
    industry standard these days.
The measurements we were givin, is what we used
to order materials, plus a **% waste factor wich is recommended by the
manufacterer. Yes, there is left over material that our supplier agreed to take
back which normally they do not. I informed our client of the shipping charges,
and restocking fee that she would be responsible for as this material is a
special order. Our client was told that we have to order more material than
what will be used for several reasons:
    1. This home is in **** ** which can get snow as
    early as September
    2. If we ran short on materials, it would be 30
days to receive more, so if we did experience a snowfall her home would have
not been protected from the elements.
All of this was explained to our client before
    she signed our contract.
After the roof was completed, our client did point
out a problem on the left rear corner of the home where the roof decking was
hanging over about an inch to far, and some aluminum drip edge that she wasn't
happy with. Both problems were repaired within a few days, and I never heard of
anything else she was unhappy with.
Our client had several requests in regard to our
billing transparency, I provided her with everything that she requested, and we
still have not been paid the balance due. She actually sent me an email at the
beginning of the year that stated " I am out of town, and will get ahold
of you when I return at the end of March"
All of our suppliers and laborers have been paid
in full for this project, but we have not.
We decided to file a mechanics lien against her
property shortly after finding out that felt no need to pay us until she was
    ready to do so.
She was notified of the lien last week, and that's
when she decided to write to the BBB.

This is our 10th year in business, and we do
strive for 100% customer satisfaction for all of our customers, and are very
proud of our great rating with the BBB.

The roofing materials I chose to use was not a special order.   The color, as well as the style of shingle came directly out of a brochure that the manufacturer sells and distributes.  Allied never informed me prior to installation of the new roof that the manufacturer requires a 20% waste factor.  The usual is 10% and that is usually too much leftover.   Allied ordered 158 bundles of shingles and 39 are leftover (not including loose shingles), then that is a 25-33% of leftover materials.  21 bundles of hip and ridge were ordered, 9 bundles are leftover.  That is a 40% overage.  And, based on the garbage pile of cut shingles, yes, there was excess waste.  Someone made a huge mistake when they ordered the materials and they should own up to it. The roofing subcontractor overhung the shingles too far over the roof on one side.  As I mentioned in my complaint, that was one mistake that was chosen not to correct.

I am rejecting this response because:

Allied’s response is not correct.  I was surprised to read that they placed a lien on my property, this is the first I heard of it. I am sorry they felt they had to resort to this action.  I just returned to **.  Mail is not delivered to said property and I have not gone to the PO or the house yet. The last correspondence I received from them was an email on 12/6 in response to my request for the cost of the materials.  There was no communication thereafter from them - no emails, no phone calls, no billing.  In November I requested info with regards to the cost of materials, labor to install, and in particular how to deal with the leftover materials so that I could make an educated decision whether to return the overage, keep it, or donate it to a charitable organization.  If the materials were picked up and returned to the distributor, I would be mailed a check for approximately $*****.  I contacted the BBB at the beginning of the year to inquire about filing a complaint.

My satisfaction of the job is Allied’s interpretation.  No, I am not happy with the way the roof looks, but settled to leave the work as is.  I was glad to get the work done before winter and appreciated that fact.  I believe that two of the mistakes could have been caught and corrected long before the roof was finished:  (1)  I settled on caulking and painting the underside of the decking that overhangs the roof on the back corner of the house (2) Both Allied and I decided to leave the shingles that overhang too far over the edge of the roof on one side as is.  The third mistake was corrected.

    Sincerely,

    Sandy ******

?Hi Dan, I do not think we are communicating very well via emails.  I would like to set up a time when we can meet at your office and discuss the excess roofing materials I am storing in my garage as well as the bill.  I am out of town and will not be returning until the end of March.  I will call you then to set up a time that is convenient for both of us.  Sandy

I am rejecting this response because:

What statue allows your attorney to put a lien on multiple properties that I own?  This is a deceptive practice.
