    On March 27, 2024 I paid Cat Construction $6,004.42 as a down payment on repair work for my shop roof as the result of hail damage. Cat Construction spent many weeks negotiating with my insurance company for more coverage to complete these repairs. They gave me an estimate of $58,858.39 to complete these repairs stating that I would not have any out of pocket payments (except deductable). Insurance allowed only 38,700.00 for repairs.

    On June 24, 2024 I was notified by Cat Construction that my insurance carrier had denied coverage for the amount Cat Construction was charging. ***** at Cat Construction then told me they would not be able to complete my job with $38,700.00, They could only do a partial repair. I asked if I could get my deposit back and find someone who could get the job done within the insurance limits. He said no. I then sent them a Cancellation of storm damage roofing repair contract under SD Codified law 37-24-51, requesting to cancell my contract and receive a refund of my depost.
    I received an email back from them stating they would refund me $4,425.04 of my deposit. They are wanted to keep $600.44 for sales commission, $821.00 for negotiating a higher insurance payment and $157.94 as a handling fee. I responded that I would agree with all the charges EXCEPT the $157.94 handling fee which appears to me to be a "junk fee".
    The last communication with them states they have sent it to their legal department and I have waited several weeks for a resolution. I did NOT receive a written contract that I had signed in agreement to any of this. This company is not acting with integrity when charging these fees upfront and promising to do my repairs and not fulfulling their agreement to me.

    ***** originally signed a contract with CAT Construction on 3/13/24. On 6/24/24, ***** and ***** had a phone call where he explained to her that she had reached the maximum coverage of her insurance policy and the maximum allowed was not enough to complete her project. On 6/14/24, ***** and ***** had a call where she said she wanted another company to handle her siding and windows and just have CAT Construction do the roof. On 6/18/24, ***** and ***** had another phone with him explaining the maximum coverage allowed on her claim. On 6/24/24, ***** and ***** had a 3rd phone about the maximum coverage allowed on her claim. ***** then decided she did not want to proceed with CAT Construction for her roof repairs. ***** was way past the 3 day cancellation time frame in the contract. CAT Construction understood this was an exception as her policy coverage maximum was met and we agreed to a refund of some sort of her initial $6,004.42 down payment. At no time did ***** or any other representative of CAT Construction tell ***** "no" we would not give her a refund. The amount of $4,425.04 was determined by *****. This was to include *****, the sales representative's commission, *****'s commission on supplementing *****'s claim up another $8,000.00. Meaning through emails and documentation to her carrier, ***** got ***** $8,000.00 more in coverage on her claim. The handling fee or "junk fee" as ***** calls it of $157.94 was to account for standard operating costs such such as fuel in vehicle used to by ***** in meeting with *****, office supplies used in the creation of her file, reports generated using photos taken for measurement of her property, etc. Definitely not junk just standard costs involved in the running of a business. Per the contract, we could have charged ***** 10% of her initial RCV amount of $24,017.70 that she signed the contract for. Which would have been $2,401.77. We wanted to be as fair as possible to ***** so we did not use that amount and went with the amount calculated. We apologize for the discussions with our legal team taking a bit of time, ****, the owner of CAT Construction was out of the office 8/2/24-8/11/24. In final discussions with the legal team on 8/14/24, it was determined that ***** did not account for his estimate commission for *****'s claim of $480.35 or the SD Department of Revenue Excise Tax paid on *****'s $6,004.42 which was $120.08. However, that could also be accounted for in the handing fees of $157.94 that ***** does not feel she should pay as they are "junk".  Even with CAT Construction missing these amounts, it was decided to give ***** a refund of $4,582.98 which does not include the handling fees in dispute. ***** called ***** on 8/15/24 to relay this information to her. He left her a message. The check was put in the mail yesterday, 8/16/24 also which is the date she filed this complaint.
