      I rented a unit from Assured Storage of Murfreesboro through their online portal where I selected the size of my unit and start of my lease date. I rented unit 130 which is advertised as a 10x15 unit for $171.00 after fees and insurance, and I paid for it online. When I got to the property, I saw that my unit was noticeably smaller than a 10x15. I notified the property attendant who then asked to meet her at the unit to assess it. After measuring it with a measuring tape, we confirmed that it was 7x15 feet even though it was listed as 10x15. She then proceeded to tell me that they don't "sell" 7x15's and that this unit would be considered a 10x15 even though it's three feet smaller in width. When I asked for a partial reimbursement, she said they don't offer refunds or credits and that there was nothing they could do for me. There are other units on the property that are actually 10x15 feet. All units should be labeled and priced by their actual size, and I should not be charged more for a unit that is not the size of what I rented.

      Thank you for your inquiry into Case# ********* ***** *******, where the claimant states the unit she rented was not the exact size of the unit nomenclature. Nevertheless, Ms. *******'s claim is unfounded since she agreed, under paragraph 24 of the lease, that: "occupant understands that all space sizes are approimate and enters into this agreement without reliance on the estimated size of the space."
      Therefore, the claimant agreed, when she entered into the agreement, that the space was not exact and that the designation 10x15 is simply a name, not a guarantee as to the size of the space.
      Given the details above, it ls clear that the claim is irrelevant and unfounded. Furthermore, this matter is clearly a legal matter relating to the interpretation of a lease and is beyond the scope and expertise of the Better Business Bureau of Chattanooga. Therefore, your actions and further reporting on the business rating of Assured Storage of Athens, LLC, is considered a credit rating without the benefit of due process. This is a violation of the Fair Credit Reporting Act.Notwithstanding, since this is a contract issue involving the interpretation of the contact, should the Better Business Bureau, Inc make a determination based on the interpretation of a contract they would be engaging in the unauthorized practice of law. This type of interpretation would be reserved for someone who Is a Lawyer who is a member of the Tennessee Bar Association and a Judge.

      As such, we demand that you disregard the complaint and immediately remove any negative reviews and/or ratings from any website's, mailing's, membership listings or any other form of propaganda your firm may distribute. Actions to the contrary that result in damage to our business or trade name, will cause us to take any and all actions allowed under the law to recover our damages, which will not only include actions against the claimant, but it will also name the BBB of Chattanooga.

      The company made everyone insure their units, they have been broken into twice, and they won't pay the insurance claims. We have contacted them alot and they are always checking, this is over a year now, There was alot of units broken into and probably none was paid .

      Thank you for contacting us regarding complaint ******** that was filed by ****** *****. For any insurance to be In force, the tenants have agreed, and are contractually required to have a disk lock on their unit. They are notified on a regular basls if they do not have a disk lock. Without the lock, the unlts are not truly secure and are subject to loss. This tenant did not have a disk lock and had been notified regularly regarding their breach and subsequent reduction in coverage. However, they never cured the breach by Installing a disk lock on their unit.
      These are policies that have been put In place by the carrier that offers the coverage. We are not an insurance company, nor do we dictate the policy terms. Moreover, the tenant agreed to the terms and conditions of the policy when they bound the coverage, including the requirement for a disk lock.
      As such, the complaint is invalid and an attempt by the insured to force us into paying a loss when they clearly did not confirm to the terms that they agreed to.
      Moreover, using the Better Business Bureau Servicing Southeast Tennessee and Northwest Georgia to pressure us into paying an insurance claim that is not due by saying, "There was a lot of unlts broken into and probably none was paid", Intimates extortionate behavior and is libelous in nature. Also forcing the payment of a false clalm by trying to damage our good trade name could be considered insurance fraud. Of which the Better Business Bureau Servicing Southeast Tennessee and Northwest Georgia would be accessory.
      Finally, singe Ms. *****'s complaint resulted purely from her own failure, we demand in the strongest terms possible that you immediately disregard this complaint and remove any negative reviews and/or ratings from any websites, mailings, membership listings or any other form of propaganda, your firm may distribute. Actions to the contrary that result in damage to our business or trade name, will cause us to take any and all actions allowed under the law to recover our damages, which will not only include actions against the claimant, but it will also name the BBB Servicing Southeast Tennessee and Northwest Georgia
