****** claimed to provide certified negative air duct cleaning. I paid him in good faith assuming he would deliver that service. He did not. Then after admitting that he was not performing negative air duct cleaning because he was in a rush after showing up 3.5 hours late, and agreeing to refund the money, he did not. I will now be taking all actions necessary to get my money back and depending on how hard it is to get my money back I will also be very public with my experience.Business Response

We have already tried to offer half of the money to this customer numerous times or to come out and do whatever he thinks needs to be completed. We were there 5 and a half hours removed mold and cleaned his air ducts so his newborn baby that from my understanding about to come into this world. All the black nasty mold was removed and any other harmful bacteria inside both of his hvac systems. He had already opened a file with PayPal the system we use to run cards to try to get his money back. He wants all of his money plus more for some reason but our policy and invoice he signed stats that the only way we could even try to refund all of his money we would have to come and remove the equipment that we cleaned and serviced. Both systems and that would cost the customer a lot of money to replace and we dont want to do any customer that way. He argued with me back and forth for days after we were done with his job and he paid his invoice in full. It was the next few days he started putting 3 fake 1 star reviews on ****** trying to slander our business when we did exactly what we were supposed to do. I *********************** made sure to get every speck of mold from both of his systems because of the new baby coming to his family soon. I wish we would have never crossed paths with ************************** but we did the best possible job we could for him and his family.Customer Answer

I am rejecting this response because:The response from *********************** is knowingly false.
1) *********************** nor any representatives were at my home for 5.5 hours. Nowhere near it. *********************** was 3 hours late for the appointment, spent 1.5 hours "inspecting" and quoting services, 30 minutes smoking in his car, and about 30 minutes cutting off returns upstairs. He then started his work, which I rapidly discovered was not what he had told me he was going to do. *********************** then admitted that he couldn't perform the services that he had sold me due to a lack of equipment and lack of time. I told him to cease at that point.
2) I explicitly requested that *********************** perform mold removal and anti-microbial fogging FIRST (priced at $580 on the invoice). He told me that was not possible - that both systems first must be fully cleaned for the treatment to be effective. He now tries to claim that he removed mold without cleaning. Which one is the lie?
3) Nowhere on his invoice which I paid in good faith up front believing that *********************** was not a fraudster does it state that he may remove my systems. It states "the seller will retain title to any equipment or material furnished until complete payment has been made." *********************** did not furnish either of my HVAC system, nor any piece of material or equipment on either HVAC system, nor any piece of material or equipment still in my home. To argue that he retains title to my entire HVAC system is laughable, and completely inconsistent with his own invoice and contract. This is just another example of *********************** trying to create additional scams to further his position.
4) At no point did *********************** try to initiate a refund with ******, although he continuously argued that he would if he could (just like he claims in this BBB response) and that Paypal was preventing him from doing so. Numerous Paypal employees and supervisors confirmed both in writing and verbally that *********************** always had the ability to refund - he was choosing not to.
5) At no point have I requested more than the money paid to *********************** for the services he did not perform. In fact, in an attempted gesture of goodwill, I offered to allow *********************** to keep $100 as a service call charge since he did in fact show up at my home to inspect and quote services. This is more than generous since *********************** and Elite Air Care advertise free estimates. But I wanted this to be a smooth parting of ways, so I offered him the $100 as a service charge. He still has the $100 today, along with the rest of my money.
6) *********************** and Elite Air Care added a line item for taxes on the invoice, claiming that this was required by the state. Since then, I have discovered that the state of Tennessee does NOT charge sales tax on services such as this. This was just another element of the elaborate scam that *********************** runs under the name "Elite Air Care."
7) The reviews I have left and will continue to leave on the business are completely accurate and factual. Calling them slanderous is false - making statements of fact is never defamation nor slander. My reviews make statements of fact; that is all. My intent is to protect the public from a business that preys on low-income families by selling them fake services that are not performed. *********************** admits that he "does much better with low income people." This type of predatory admission is why it is necessary to continue to fight to publicize the scam as much as possible in order to limit his number of future victims.

We have argued with this customer way too many times. We completed the mold removal from both of his hvac systems first before we started cleaning his air duct system. I told the customer I couldnt fog the antimicrobial through the ductwork until all the ducts were cleaned. That was the last step that we couldnt complete because his pregnant girlfriend came home at 7pm. We started working at 2pm that day at his home and left at 7:30pm that night. He agreed to allow us to come the following Tuesday to finish but the next day he changed his mind and decided that everything we did in his home the day before was worthless to him. I offered $777.50 which is half of the job but he declined numerous times and he only wants every ***** back or nothing. I even offered giving him a full refund if he would drop his dispute with PayPal and now his bank and we could pay him pay him back @ $400 a month until the invoice was paid back in full minus the service fees. We have completed thousands of jobs and never have we ran across such a lying customer. Also we charge a service fee not sales tax to help cover gas, materials and mold killing chemicals instead of raising our prices like every other service company to cover how expensive it is to run a small business.

I am rejecting this response because:
1) *********************** did not arrive at my home at 2pm, nor anyone from his crew. False, and provable with both call logs and doorbell camera footage.2) The invoice was sent and paid at 4:30pm, a signal of the conclusion to his inspecting/quoting period.
3) Anti-microbial fogging is part of the mold service on the itemized invoice. According to his invoice, the mold service with 2 year warranty is a total of $580, not $775 or whatever he now claims.
4) He illegally charged TAXES not a service fee as he now claims.
5) He still holds 100% of the paid funds totaling $1798.83. Given his proclivity to lie and provide false statements, no resolution will be acceptable until actual funds are returned to me. He cannot be taken at his word.
If *********************** wants to make an actual offer of settlement, and then follow through on that settlement with real funds being returned, I will entertain it. What I will not entertain is further lies about the time spent here or services performed or false tax charges or anything else.
If *********************** is unwilling to deal truthfully and settle in good faith, this can remain unresolved with the BBB and move into a lawsuit where objective parties can determine and enforce appropriate resolution.
