    Tristan ********************** tore down a 20-year old fence and installed a replacement fence for me in April 2023. Last Fall, I noticed a wood panel splitting and reported it to him right away. At that time, he said he didn't have any jobs in my area, but would replace the panel when he had another job in my area. On April 16, 2025 (only 2 years since installation), I noticed many other panels splitting and two bowing. I reported this to ******* by phone and followed up with text photos that same day. When we talked, he said he would take care of it, but has since not replied to my text messages. Since I've given him multiple attempts to resolve this, I suggested yesterday that he refund my money so I could hire another contractor. Still no reply. I have to get this resolved before my HOA fines me for repairs needed. Thank you for your assistance.

    Mrs. ****** came to be to replace her fence that was severely dilapidated and falling apart. Over a year later she contacted me wanting to replace some fencing material that was installed that had either cracked or warped. It was communicated to her that when I have a job in the area I would be able to assist her. Since then I have not had any jobs in that area. The wood conditions and how the wood reacts is to no fault of my own. ****** expands and contracts and also shrinks when moisture is removed from it. The minor cosmetic concerns of the customer did not occur from installation as there is no complaint of anything falling apart which means the installation was done to exceed standard installs. The customer if wanting items replaced would have to incur costs as this is not to the fault of my company or the install itself. The customer is actually asking for more money than the fence cost itself to tear down the old one and install a new one. The customer is being defamatory in her expectations that my company can control how lumber dries. I would not do any work for this for free as the customer is attempting to get. The customer needs education on how lumber, treated exterior lumber to be more specific before attempting to file groundless complaints against my company.

    I am rejecting this response because: ******* offered last Fall to replace the first piece of wood that had cracked. If none of this is 'his fault," then why did he accept responsibility for the first problem and not those that followed? I suspect he used very cheap wood expecting to get away with it, and that's not acceptable. If he wants to resolve these problems, that's fine with me. Otherwise, I'll have to pay another contractor which would be completely unfair for me to burden that cost. As I said before, the fence he took down had been up 20 years. His started having issues within 18 months! It was installed in April 2023. There were no issues with the old fence he took away until at least 15 year after it was installed.

    Mrs ****** may hire whoever she pleases to replace dog ears that were purchased from a nationally known company (*****). ****** is never guaranteed and fault was not claimed by my business. I simply stated I would replace them when in the area again but it would not be for free. I also offered a refund of the wood cracked approx. $6 to be generous. The customer declined. The fence that was there was completely dilapidated and was like that for many years no matter how long it was standing. It had cracked lumber as well which more than likely happened in the first year as all treated lumber may. Lumber is never guaranteed and what the customer is claiming is less minimal to what is seen elsewhere. There will now be no assistance from my business in assisting the customer with anything further as her compromise is to refund her more than the full amount to include the staining of the fence for minimal cracked lumber which is more than common in pressure treated outdoor lumber.

    I am rejecting this response because: this is a 14' fence in which I have issues with over 2' of it at this early stage in its life cycle. I don't believe the wear and tear I'm seeing this soon is normal, but I don't work in this industry.  Besides the splits in three pieces of wood, two are bowing (one in, and one out). One of the posts is now splitting as well.

    Unfortunately the bowing of the boards will happen and was brought to your attention early it was also brought to the attention of your *** but due to the required design and uniformity of fence design by your *** that design is required. You were advised before and after that bowing of fence boards may happen due to the distance between the top and bottom rail and no center rail. To be clear the fence is not 14 feet tall. It is only 6 feet. A rail gap of 5 feet or more can and will cause board bowing. Unfortunately that is a poor fence design by your ***. This was discussed with you. It was also discussed with the *** to change the design to eliminate this issue in which I was informed it would be brought to the discussion table. But this is a design flaw not my craftsmanship.

    I am rejecting this response because: referenced conversations with me did not happen. If they were conducted at the *** level, I was unaware of them. Further, I reject this response for all of the previous reasons stated.
