    The definition of fraud includes a misrepresentation of fact that is either intentional or negligent and causes harm to the hearer who relies on it. My complaint is that I registered for a Certification in Supply Chain Management course at the University of Tennessee continuing education program and paid for the course. The cost of the course was $2,559.00. After completing the coursework, I was then told that to take the exam, I would have to pay an additional $1,390.00 for the exam cost. I have all my course documents, including my receipt, course notes, course expectations, and certificate of completion. However, in all the papers, it is not mentioned that additional expenses were needed to sit for the exam. The course misrepresented the fact, intentionally or negligently, that an extra cost was included. I have experienced great harm because I would not have signed up for the class if I had received full notification of the additional fees associated with the course in the beginning. I invested time, money, and effort in a course that is essentially worthless. That essential information was not disclosed at the beginning of registering for the course, nor in any of my documents, nor were there any additional fees associated with the course. I have contacted the certifying body of the Association of Supply Chain Management. I have contacted the University of Tennessee Continuing Education Department and have received nothing short of the runaround. Just to put this egregious action in context, my mother and father were denied the opportunity to attend school growing up as a child and never finished high school. However, they encouraged my siblings and me to continue learning new skills. As an African American single mother of three children, I worked, saved, and sacrificed, and my children went without some essentials to pay for this course, which turned out to be a misrepresentation of the facts that were never disclosed until I went to schedule the exam.

    On October 14, 2024, the University of Tennessee at Chattanooga
    ("University") received notice of the above-referenced complaint
    filed by ****** ******. The University denies Ms. ******** complaint that it made
    misrepresentations to her.

    In the Fall of 2023, Ms. ****** enrolled in the University's Certified
    Supply Chain Professional (CSCP) course ("Course"), which is
    administered by the UTC Center for Professional Education. The Course prepares
    enrollees for taking the Certified Supply Chain Professional (CSCP) exam
    administered by *********** *** ****** ***** ********** ****** for obtaining
    certification in supply chain management (the "Exam").

    The tuition cost for taking the Course in the Fall of 2023 was $2,559.00.
    The University invoiced Ms. ****** for the Course tuition on July 27, 2023. A
    copy of the invoice is enclosed. The invoice provides that the fee charged is for
    the 14 online sessions of the Course offered from August 21, 2023, to December
    11, 2023. The invoice did not state that it included a voucher for the Exam
    fee, nor did the University ever represent to Ms. ****** verbally, in writing,
    or otherwise that her tuition cost included a voucher for the Exam fee. Ms.
    ****** paid the invoice via credit card on August 14, 2023.

    On August 18, 2023, the University e-mailed all Course enrollees information
    in preparation for their start of the Course the following week. A copy of the
    e-mail is enclosed. The e-mail specifically advised the Course enrollees that
    they received a one-year ASCM membership as part of their enrollment and that their
    "membership will allow you to receive the discounted exam rate,"
    clearly indicating that they would be required to pay the Exam fee on their own.
    Ms. ****** confirmed receipt of the August 18 e-mail when she responded on
    August 19 to submit her signed copy of her student expectations and attendance
    policies form. Subsequently, in the same e-mail thread, Ms. ****** inquired on
    August 26 as to how and when she could sign up to take the Exam. The Course
    coordinator provided her a link the ******* *** testing center for that
    information.

    As clearly reflected in the August 2023 e-mail communications, Ms.
    ****** knew or should have known that her tuition fee did not include an Exam fee
    voucher. At no time did the University represent otherwise or attempt to
    conceal that information from her. The University delivered the Course to Ms.
    ****** and thus fulfilled its obligations to her. The University denies her
    request for a refund for the Course.
