I had an accident in the summer of 2018. I had my car towed to Mizell's Auto Collision. he assessed the damage, and we thought that about $4000-4500 would cover the damage. I informed him that I was tight on finances and gave him a down payment($2000) to start the work. Over the next two years, he worked with me to slowly filter him more funds as I got them. I moved out of state, but kept in contact with him to make sure the work was going as it should. By the summer of 2021, I had paid him exactly $7,000 in CASH total. At that point, he made it clear that it was just a time/help issue. It was way more money than we had initially talked about. The probelm came when month after month, year-aftger-year, he kept putting me-off. I know he and his immediate family have been riddled with health problems, or at least that's what he tells me. Since 2021, I have been contacting about finishing my car, but he always avoids my calls. There's always another excuse. FOr the last 6 months he won't even answer my calls, and now it's October of 2023, and that car is still half-way done. I have been paying 420 a month for the car payment, and about 100 a month for the insurance the entire time. To say the whole even has been taxing on my family - is an understatement. I just want the car fixed, or refunded a portion of the fuinds to have someone else finish it. He worked with me for the first 2 years as I filtered him, again, the total of 7,000 IN CASH.

I call BBB to answer this letter but was told it had to be done online. I had to ask someone to help me with this so it has taken me a while.

This customer brought in his wrecked vehicle that was uninsured and needed a shop that could do some pay-as-go type work.  This is not the type of work any body shop would normally take in, however, I agreed to work with him. A good bit of work has been done to the vehicle at this point and I estimate I owe him approximately $1500- $2000 in work. During the time the vehicle has been out here the customer did not have funds when I could work on it and when he had funds I was not in a position to jump on it but did what I could when I could. During this time my mother and two of my brothers passed away during a 6 week span and that caused personal issue that caused me quite a lot of trouble. In the past year I have had triple bypass surgery, colon cancer, and kidney cancer. The last surgery was in July. I am still recovering and have not worked very much in the last 14-15 months.
I have not ignored his calls as I answer my phone as you would expect any business to do. I don’t know his number, so I would not recognize a call from him if he did call. If at any point he had left me a message or had come out during regular business hours I would have gladly had a civil conversation with him.
I’m not sure  how the fact that he is still making payments on his car plays into this, it is not my fault he is still laying on a wrecked car that was uninsured.  I was out of town this past weekend and when I checked the camera when I returned, I noticed him on our ring camera stating he wanted to pick up his car. This car has never ran since he brought it out so he would need a wrecker to pick it up. Then he sat in my driveway and honked his horn for a bit of time. Odd behavior. But like I said, I would gladly speak with him at any point.  I believe $7000 is an  excessive quote.   If he will come out and speak to me respectfully and reasonably, maybe we can work something out.
