Bought a car a 2013 Ford focus from Chris. Payments were $258 a month. Due on the 13th of every month. February 8th it was towed to the police inbound yard. Chris gets it out on 2-9-23. Chris considered it as a repo on February 9th. 6 days before the payment was due. Chris sold the car on 2-21-23. Chris did not let me get it back from inbound. Counted it as a repossession before the payment was due. Chris told me he sold it a week later before the payment was due. Chris is not a reliable man. Chris got greedy and wanted more money so sold it before the payment was due. Chris threw away most of my stuff and gave 1 bag to my father and threw everything else away or kept it. Chris is very shady and you can't reposess a car before the payment is due because he wants a bigger profit. But Chris did.

****** ****** Contrac twas signed on 11-29-2022. At the customers request the due date for the contract was moved to the 13th of each month. On 2-8-23 Cherokee Financial Serrvices collateral was siezed & i mpounded by the Bradley County Sheriffs Dept. On 2-9-23 Cherokee Financial Services paid the impound fee and stored the vehicle at our facility free of charge. ****** ***** made no communication and we were made aware of an arrest. ****** missed his 2-13-23 payment. State law says that an account has to be 10 days past due to be repossessed. On 2-23-23 (10 days past due) still with no comunication from ****** *****, Cherokee Financial Services officialy repossessed the 2013 Ford Focus legally & lawfully. State law for selling a repossessed vehicle states that the customer must be given an additional 10 days after the repossession. ****** **** contract was broken and the collateral was sold on 3-9-23 which is 4 days past the required time held. The collateral was sold for the exact payoff, no more no less.

I am rejecting this response because: chris reported the car as stolen when he had it towed when I was in the hospital.  Late January. I picked it up on 2-7-2023. I was pulled over on 2-8-23 because the car was reported stolen by Chris L****. I was arrested for possession of a stolen vehicle. Which was my car. This car was not used to commit any crimes, the criminal case  possession of a stolen vehicle was dismissed.  Chris reported to equfiax on 2-9-23 that it was a repossession. On 2-21-23 Chris reported to equfiax as a paid repossession.  Chris didn't wait the required time. My father came by when I was in jail and tried to make the payments to keep the car for me Chris declined and wouldn't accept it. Chris told me the car was sold on 2-21-23 yesterday Chris told me he was suing me for the unpaid loan. This loan was paid when the car sold. As Chris stated vehicle was paid for the payoff. Therefore no money is owed. I am requesting my credit report to be corrected and him to dismiss his civil suit He was bragging about.

    Sincerely,

****** ***** credit will 100% not be changed or altered. We report accuratley & correctly. Cherokee Financial Services has this responsibllity to do so and will not deviate form this responsiblilty. ****** ***** vehicle 100% wasn't reported stolen (This statement is ridiculous). ****** ***** wasnt arrested for a stolen car he was arrested for New Bill Capias: Financial Exploitation of elderly/vulnerable person. Police booking report attatched. All of our records show these correct dates. The repo date 100% wasnt 2-9-23 but 2-23-23. The sale date was 100% not 2-21-23 but 3-9-23. Cherokee Financial Services 100% doesnt have a law suit against ****** *****. The vehicle in question was sold on 3-9-23 for the payoff, no more no less. ****** ****** father never offered any money once ****** was arrested for financial fraud, he actually said just the opposite that he cant help his son. Cherokee Financial Services employees are bound by law to not discuss or bragg about anything a customer may be facing. ****** knows the truth and has been told the truth over & over again. He is more than welcome to have as many copies of our forms & records as he may disire. What will not happen is Cherokee Financial Services be forced to change a credit report that has been filled honestly & correctly. We would not be telling the truth if changed our credit file on Mr *****. Proof of what ***** was arrested for is being uploaded.

    Complaint: ********

I am rejecting this response because I was originally stopped by the police because the car was reported stolen by Chris l****. Chris also told me he was going to be suing me for the value of the car. As far as the arrest. Innocent until proven guilty. It was dismissed.  This car was never used in the commission of any crime. The alleged crime was said to have been committed in 2019. Again was dismissed.  Chris will not give me the paperwork that he claims he has. He told me I am not allowed back on his property.  I was nice enough and dropped off the key. I should have just thrown it away. Chris reported to equfiax on 2-9-23 that this car was a repo 4 days before payment was even due. If it was repoed on 2-23-23 it would have not been reported on 2-9-23. Chris is a liar. And is a disgrace. He makes all used car dealers  look bad. The credit report is not accurate because Chris falsified it to cover his lies, he reported to equfiax on 2-9-23 that it was a repo 4 days before the payment was even due. Chris told Me he is suing me for the value of the car. Even though he has stated that he the car sold for the payoff. The credit report wasn't filed honestly.

    Sincerely,
