    A ********* resident, *********************************, absconded with over $100,000 of my money. He represented himself as a fiduciary of a home-building company. He does not have a license to operate as a contractor/builder, and neither does the company. These funds were a down payment for my family's home build, but he did not build anything. Instead, he delayed construction and misappropriated my money for his own use. He obtained my money under false pretenses and deceptive practices and failed to tender anything of value in return for our payments. May 3, 2021: We wired ****************** the initial payment of $5,000. ****************** knew we needed to sell our existing home to afford the down payment for the new build. April 1, 2022: We sold our home to pay for the remaining down payment for the new home. April 6, 2022: We wired the remaining down payment of $140,000.00. ****************** recommended we sign a 9-month lease for temporary housing for the duration of the build. January 2023: ****************** assured us construction would begin soon and advised we sign a 6-month lease for temporary housing. I attempted to resolve this matter directly with Mr. ******* by executing a Mutual Release Agreement on July 8, 2023, which stated the full funds would be returned to me by August 7, 2023. ****************** has returned a small portion of the total funds owed and currently has an outstanding balance due of $135,000. He is still continuously stalling about returning the remainder.A similar case in TN court records mirrors my own situation. In this case, ****************** was supposed to build a home for another party and failed to do so. Instead, he willfully and maliciously misappropriated, embezzled, and stole the other partys $200,000 that had been entrusted to him to build their home. This underscores the nature of our issue because he is doing this to other people. Our refund issue with ****************** is not an independent incident. ****************** must refund the money to me as promised.

    Dear BBB, Thank you for your assistance. Their response of a "total mutually satisfactory resolution in at most few weeks most likely a few days," is the same story I have received from them since they missed the refund deadline in July 2023. I need them to provide my refund in order for this matter to be concluded. Therefore, I am unable to "accept" their response until they return my money. I am rejecting their response so the case remains open. I will update the BBB and let you know if they send any of my money back. Please contact me with any questions. Thank you again.

    The response has been rejected because: This is the same story I have been hearing since the missed refund deadline in July 2023. This response is rejected as it fails to provide any concrete resolution. This matter will only be concluded once the agreed-upon refund is returned to me as promised.
