    On May 3,2024 I purchased a home from Perros Properties and closing was at First Priority Title. In the closing statement there was $2000.00 allocated for the selling agent **** ******/Realty Executives to purchase me/ the buyer a home warranty policy. To this day of July 2,2024 that policy has not been purchased. First Priority Title has relinquished the allocated funds to **** ****** without a policy being purchased.. **** ****** says she can't purchase the policy because the builder won't give her information, she has washed her hands of the matter. This money should never have been dispersed without a policy. The title company will not return any calls from myself, my realtor ****** **** nor my realtor's broker ***** *****

    7/16/2024 Dear BBB, I apologize not to reply sooner, but I've been on vacation without access to phone nor email since June 28th.  Please see attached - the letter we received from Ms. ***** on July 3, 2024, and our attorney's response sent via certified mail on July 12th.  Also attached is the settlement statement the buyer and seller signed at closing, authorizing disbursement.  In the State of TN, builder is to provide a one-year home warranty to the buyer.  This was done at closing - copy attached - and provided to the buyer at closing.  Page 2, lines 703 and 704 on the settlement statement shows commissions paid to the buyer's agent and the seller's agent.  Page 2, Line 1303, buyer pays her buyer's agent commission in the amount of $3300.00.  Page 1, lines 209 and 509, showing a $3300 credit from the seller to the buyer.  Seller's realtor had a fee for "additional commissions" on page 1, line 518, paid by seller.  The realtors told the buyer they would be purchasing a home warranty for the buyer with the "additional commission" money, an additional warranty in addition to the standard builder's warranty that was already provided.  First Priority Title was no part of that - we closed per the sales contract and disbursed per the settlement statement (attached), that was reviewed and agreed upon and executed by the seller and buyer.  Our office is holding no monies - everything was disbursed at closing, exactly as listed and required by law.  This is a completely frivolous claim, and you may contact me or my attorney, ****** ******* for anything further needed.  Sincerely yours, ****** ** ****** * President
