    Nature of the dispute: My brother and I traveled to Kodak, TN, with the intention of purchasing two new quads. Prior to our visit, we had arranged a week in advance and were assured of a discount ranging from $300 to $500 if we were to acquire two quads simultaneously. However, upon our arrival, we faced an unexpected delay as the necessary paperwork was not prepared, resulting in a four-hour wait. Upon inspection, my quad revealed a broken e-brake cable and a damaged back fender, issues incongruent with the expected condition of a new quad. Furthermore, we found ourselves subjected to an excessive tax assessment on the entire purchase amount, in addition to the unfulfilled promise of the aforementioned discount. Despite the passage of nearly two months, or close to 60 days, our registration remains outstanding, giving rise to concerns regarding potential penalty charges. It is worth noting that the back fender is currently on back order, and the brake, after persistent follow-ups spanning almost two months, has purportedly been dispatched.

    We were caught off guard by this complaint to the BBB as Mr. ***** and his sales person have been in touch regularly since his purchase.  When Mr. ***** and his brother arrived the sales person took very good care of them along with ensuring that he received a $200 gift card for referring his brother to come with him.  Before Mr. ***** went into the finance office we went over pricing for the machine along with having him sign a deal sheet that showed the full pricing structure for the item he was purchasing.  Then Mr. ***** went into the finance office and signed the actual contact and bill of sale with a completely transparent break down of all pricing and fees.  There were some easily rectifiable issues with the ATV that Mr. ***** purchased as stated in his complaint.  However Mr ***** was fully aware of these and aware of the replacement parts being on back order.  Mr. ***** decided to buy the ATV anyways and we would ship the parts when the backordered one came in. There may have been some miscommunication on this as we shipped the part that was not on back order last week but still waiting on the fender .  As stated there were some scratches on the rear fender along with the e-brake issue.  While he was here we wanted to make sure we got these parts ordered for him.  Mr. ***** was here for a little longer than we like but his deal called for more time due to these issues along with the time it takes for two people to purchase a machine.  Mr. ***** stated in his complaint that he has not received his registration and his concern about "fees" due to being late.  We were able to track his titling paperwork and his local BMV received all necessary paperwork on September 13 2024.  Once we send the paperwork to the state our hands are tied and we can not help the amount of time it takes his state to process it.  Of course if we charged to much for tax we would be more than happy to refund the overcharged amount.

    I am rejecting this response because:

    I have been in touch with the state of Indiana  and they have  ZERO records stating otherwise. You guys need to get on the ball and please send that off before I owe way too much for penalties. You over charged my husband, that sales person told him the $200 in store credit SEPARATELY from the $300 - $500 off from each quad price. So please make that you get your information correct from your sales representative. My husband is the ONLY ONE WHO HAS BEEN TRYING TO MAKE CONTACT WITH YOUR SALES REPRESENTATIVE.

    I have spoken with the sales representative multiple times about this customer and his time with us.  This is partly why we were caught off guard when Mrs. ***** submitted her complaint to the BBB about her husband's experience.  As stated before in the original complaint. We have sent the paperwork to the State of Indiana by certified mail.  This means we have a mailing receipt with tracking on this package.  Mr ***** also has the tracking information showing the paperwork was delivered to the "Front Desk/Reception/Mail Room" on September 13th at 5:24 PM.  I am not sure of the process that the state of Indiana follows, but I do know some other states, such as North Carolina, that hold all titles for one month before they start to process them.    As for the pricing,  Mr. ***** was very aware of his pricing on the ATV while he was in the store.   I have attached multiple different contracts that Mr. ***** signed with a full pricing breakdown and/or the full total price for his ATV.  We do manually calculate tax for our out-of-state customers so there is room for error.  However, as stated before, once the state processes the paperwork, if we apply too much tax to the deal, we will be more than happy to refund the overage.  However, to be completely transparent, we would have to send any overages charged to the lien holder as opposed to Mr. *****.
