      As Estate Trustee and ***** of ******** for ******* (age 97) and ******************* (deceased), I am submitting this complaint on behalf of *************. Mr. and ************* entered into a ********* agreement with Retirement Companies of America DBA ********** at ********************* Retirement Center on 5/29/2008. The understanding was there would be no increased fees when transitioning to a higher level of care. In addition, the ********* contract provided that in the event that the residents ran out of money while practising good stewardship of their finances, a foundation would pay their rent. ***************** passed away in 2011. ************* continued to live and pay her required fees in independent living. In June 2023, she moved to assisted living and was charged $320 per month "********* Fee". That surprise fee increased to $350 per month January 2024. The ********* contract makes no mention of 'any level' additional fee. This fee was supposedly instituted at the suggestion of an outside consulting firm at a date unknown to me.The contract does mention "no increased monthly maintenance fee when moving to Assisted Living" (AL). A later conceived "level one two and three" fee was not in the original and still valid contract. A fee by any name is still a fee. There is no way to prove a negative. There was never a mention of additional increased level fees in contract, email, or conversation. Refer to the included email from a ********************* representative which states "if one or both of you were to be in any of the medical areas separately or at the same time, the monthly fee of the apartment remains the same." Indeed it does, except for the additional fee for ********* care. We were shocked after numerous conversations with staff including ********************************* as Executive Director of ********************* who assured me numerous times that there are no increased fees associated with AL except meals and medicines.I believe this constitutes both a violation of the letter and spirit of the contract.
