On 08.27.2024 at 2:38 pm, I have "2" NO TRESPASSING SIGNS in my yard. One at tree at street and driveway. The other one attached to the front of my home near the front door. However, 08.27.2024 a man rang my door bell. I told him, "Get off my property!" See Ring Video! Then I walked down the street and saw him in a truck, H***9***33230***13737H Tree, ***************************** *******, ** *************, Truck#*** License#***** was on the truck. I asked," Didn't you see 2 trespassing signs in my yard?" He responded, " that is why I rang your doorbell instead of going into your back yard." I asked, "Can't you read?" He replied yes. I said, "NO TRESSPASSING ANY WHERE ON MY PROPERTY." I asked for his name? *********************, he replied. He said, **** sent me out here. I told him when you see a NO TRESSPASSING SIGN, DONT GO ON ANYONE'S PROPERTY! I returned inside and called his company phone#, and talked to ******* who refused to give me her last name. I asked for the name of the person at **** who told him to come on my property with 2 NO TRESPASSING SIGNS posted. She said she would call **** and ask them to call me. After 10 minutes, I called her back and asked for **** phone number who told them to come on my property? ******* stated, "she would not give me the name and hung up phone in my face!

Woodland Tree Service is a 3rd tier sub contractor for AT&T. Our contract is to clear vegetation preventing new data cable from being pulled as part of the federal governments 10 year infrastructure legislation. The utility poles are part of a legal easement and right of way for all utilities therefore contractors have a legal right to perform said duties. I dont see anything we did wrong here. AT&T is responsible for notifying when work is scheduled to be performed. We arent involved in that aspect.

I hired Woodland to do some pruning on 2 mature ****** ***s, to remove a diseased branch on a red ***, and to remove a few low hanging branches on a pecan tree at a cost of $1,935. The work was performed on 2/21/2024 and the contact is attached. The 2 ****** *** trees were lions-tailed contrary to industry standards. Substantially all internal branches on the northern-most *** were removed and somewhat less on the south ***. The south *** also had 2 primary limbs (8 and 12) and a 12 secondary removed. I agreed to have these removed without knowing that per industry standards limbs this size should not have been removed on a mature tree, except under extraordinary circumstances. Woodland should have known. The ****** ***s are now very unnatural looking (skeletonized} and are now vigorously producing water sprout clumps every few inches at the internal pruning wounds in an attempt to compensate for chlorophyll and water loss from lions-tailing. Restoration is a multi-year process of developing some water sprouts into permanent branches evenly distributed along the stripped branches through careful successive pruning of sprouts not to be retained. This will be a costly process. There are also numerous dead/diseased branches that were not pruned.Attached are pictures of what the trees look like now, and a sample of the water sprouts and of dead/diseased branches remaining.Woodlands own website has a page entitled Tree Trimming that specifically addresses industry pruning standards and the damage that practices like what they did to my trees can cause. I have attached it for reference. I met with my sales person the day after the job and the company owner several weeks later and both were dismissive of my concerns about the health of my trees. I have requested the refund I mention below as a resolution and the request was ignored.

As the customer stated, after the work was performed, I went out to evaluate the trees at the request of the customer and I agreed with the homeowner that it was over pruned. My boss evaluated the tree and agreed as well. They came to the agreement that Woodland would visit the future to correct the issue by selectively removing water sprouts. The owner called a little over a month after the work was performed a demanded a refund.

I am rejecting this response because: I require the following to resolve the complaint.

First , although it was agreed with my sales person upfront  that no arborist bucket trucks would enter the property and that climbers would be used as necessary, a bucket truck did drive up my driveway and into the yard. Residential concrete is not made to carry that load. So any work to be performed in resolution of this complaint must be done without trucks entering the property.
I will accept the following in resolution to my complaint:
A}  Woodland will come back out now and remove the dead/diseased branches that werent removed in the pruning process.
B} Woodland will provide a letter acceptable to me that acknowledges the over pruning and is specific about the restoration work they agree to perform at their expense in the future. It should identify the trees to be worked on, what pruning will be done, at what intervals and when the restoration process will be considered complete.

    Sincerely,

After inspecting the trees, the deadwood currently in the tree is a smaller terminal secondary that could have been a result from the late frost or some other external factor out of our control so unfortunately, we are unable to take responsibility. Our resolution stands, we still recommend selectively removing water sprouts three years after the initial trimming.

Hi *********: I reject the business' response and am supposed to respond by tomorrow. I would like to be able to respond by Friday if possible as I've not had time to prepare the response. Also, is it possible for me to bring a hard copy of the response and some related color pictures down to your office, instead of trying to do it online? The response will be lengthy and the pictures will exceed the max **** and I have never prepared a zip file.

In addition, I would like to discuss next steps because I don't think we are getting anywhere with conciliation.

I also left you a voicemail asking to talk to you about these things, if you would like to call. ************

    Sincerely,

I dropped off my response to the business yesterday. Am I supposed to do anything online to notify the business their response is not accepted and my response is on the way?

What does it mean that the complaint is on administrative hold? Has the response I hand delivered been sent to the business?
