      I am rejecting this response. The contractor continues to lie in an attempt to  avoid being held accountable for payments he received for work he never completed.  I spoke with the attorney he advised he has under retainer and had filed a lawsuit against me. The attorney advised there is no lawsuit and he doesnt represent ******************* or Fine Finishes. He will be contacting ***** today to reiterate that he doesnt represent him. In addition I have filed complaints with the ************* of ******** and TN attorney generals office. This contractor listed a fake contractor number on my contract and has never been registered in the state of TN. The contract written under Fine Finshes LLC has had their LLC revoked by the state of TN since 2022. 

      This  contractor did not complete the demolition, drywall and painting work he was under contract for and received payment. This complaint has nothing to do with our dispute regarding the language of the contract regarding the drywall texture being removed. Please see attached pictures. I have many more if needed  We would also love for ***** to supply his voice recordings which we never consented to, if they even exist. There are many of us in similar situation, all with the same story

The same day, there was a disagreement and ***** became very aggressive, which had been his character several times during our interactions with him. We asked him to not enter our home and we were promptly told he would be in our house whenever he wanted because he was under contract. We notified ***** that we would be contacting the Chester ************************** and have him removed from our house. Two days later we received a text message from ***** with a picture attached of our material that was inside the house sitting out by the street. He told us that ***** had put it there. My husband left the next day to make the 8 hour drive to check on the status of our home. Upon arrival at our home, we discovered that the demolition of the inside of the home was about half complete. Drywall had been only partially installed in the kitchen. We are requesting a refund for money paid on incomplete work.

      hello ******* we were following the signed contract down to the specifics what was signed and agreed upon and u failed to have us continue to be able to make repairs because u wanted to consult your attorney even though it was specifically detailed in the signed contract that we would only be sanding specific areas of the ceilings in the house u. we requested a change order i even tried to work with u on a discounted price for the extra work but u decided to go super unhinged urself which if needed i can upload the recording of the calls via the voice as i record all my interactions with clients who becomes in a way like u did for legal reasons with that being said u were then notified via our client of termination of the contract due to u not allowing us to continue to do our job on the signed contract u have our attorneys info and it seems like u still need to figure things our. our attorney advised u last time that any type of defamation would lead to strong legal recourses to any people or businesses involved so i suggest to contact your attorney as u broke and breached the contract by having/ trying to have us do extra work and then proceeded to have us continue on what was were paid for even though we couldnt because we were on the drywall finishing stages to prep for the cabinets to be installed. BBB if this complain is allowed to go through then we will just have to follow up with ********************* law office in ******* ************ to have it be removed via legal channels there is a outstanding legal law suit case against this client for breaching the contract and they have yet to do anything

      Hello and good evening we will attach the contract the change order and the invoice with the line item breakdowns. *********************** was notified after sanding down specific areas of her ceilings of the progress being made and she demanded us to do the entire house which wasn't under our contract. she threatened about attorneys we advised she do whatever she felt was needed but we would continue to work on the drywall work as contracted as we were almost done hanging and were about to be in the finish stages since there electricians plumbers and one call restoration made delays and mis haps on layout and the home owner failed to retain an building permit since they were paying there own people for all the mechanical work and structural work to this day they illegally contracted others to perform renovations without proper permits we were only contracted to do finish work. also we aren't required by TN state law to carry a state license since our contracted amount and the change order fell under our limits at the time of signing both the contract and the change order with discounts . with that being said we have a arbitration clause that's required by law to through and ************* has failed to do so. With speaking to our attorney about weather or not we should retain him for this specific manner he advised us to respond to this letter and inform that any and all contracts with a arbitration clause must go through arbitration and only when a judgment is made through arbitration we can do a refund if the judgement demands it. but we were fired and didn't walk off the job so they were in breach of the contract terms. We are ready for arbitration court and ready to go to trial on this manner. If we need too we can submit all pictures and text messages and emails also. These claims have no standing until ************* files for arbitration and wins a judgement and only then will these claims be accurate we are in the current motion in retaining **** a Nashville attorney that has represented us before in arbitration disputes. here is there response i am just now getting back from vacation so i will be getting with **** to start the process in order to force *********************** to do arbitration as-well as stop any and all defamation towards are company until she can win a court case. i will copy and paste a screenshot of the response by there assistant waiting for me to get back in order to retain them to prep for arbitration

      Hello there will be no refunds as u must go to arbitration as for the signatures ur signature for both documents match exactly so unless u want to retract that ur signatures arent ur signatures on everything then be my guest to prove that. Agian as I have stated before we didnt quite we were fired due to them wanting additional work being done I have the texts to prove this. You can clearly see on the line item in the invoice that it showes in the description that was made that were were only doing certain areas of the house. We are already in contact with the consumer board in which we have aleady submitted these documentation as she is required by TN state law for arbitration. We dont need a state license and in the contact it doesnt state its a TN license it says licensed inside the state of TN please read the verbiage . Anymore communication after this is mute at this point as I have provide the contract in which it states u must go through arbitration which if anyone does there research requires u to do so.so I will let the BBB actually do the research and confirm what a arbitration  clause inside a contract means

      Once again ******************* of Fine Finishes LLC (LLC was revoked by the State of Tennessee -Labor & ************** on 8/9/2022)  is deflecting from the fact that he was paid for work that he didn't complete. My dispute has nothing to do with the removal of the drywall texture. I want a refund for the money he was paid for work he didn't complete. I have supplied proof that the work was not completed by way of pictures.  

      At this time, the more concerning fact is that ***** is supplying false documents with what he claims is my electronic signature. This is the first time I am seeing the "change order" and "updated invoice". The change order and updated invoice submitted to the BBB are completely fake and I implore ***** to think twice about claiming I signed the change order.  The creation of the fake document with the claim that I signed it is fraud. ***** knows that in the State of *********, he must be a licensed comtractor to contract over 25K and he was not licensed. Please see the fake contractor license number and he listed on the contract, which does not exist with the State of Tennessee. The fake change order is his attempt to make the contract look as though it was under 25K. I am requesting that ***** provide confirmation records from the provider that was utilized to obtain this electronic signature on the change order, which he will be unable to do. I will be reaching out to TN ********** of ******** Affairs and TN ************************ to update my complaint and alert them that ***** has falsified documents and forged my signature. In addition, I will be reaching out to local and federal law enforcement to report this forgery. I will also reach out to the new attorney he has provided and alert them of the fraud he is attempting to commit.

       In addition ***** has threatened myself and others in responses to online reviews that are truthfully relaying our expereinces with him. Evidence of that can be found here. ****************************************************. His response to my review pretty much sums up our experience with him. This isn't the first time he has threatened me or my husband.  Myself, along with others will continue to alert people of the TRUTHFUL negative expereince we had with *****.  He attempts to imtimidate myself and others to try to make us go away. I am not going away and I will pursue every avenue avaiable to me until I am refunded my money.

      You copied and pasted an electronic signature from the contract *****.  Electronic signatures are logged by IP address with the date and time.  Please prove that I electroinically signed this document or which website this document was signed through and I will contact them myself to prove you are lying. I signed the contract through Rocket Lawyer and they provide receipts showing that documents are electronically signed. We will wait for you to gather and send this information.  The date of the change order is in June 2023, because as you were creating the fake document you failed to change the date. We didn't even own this home in June 2023. You were hired on November 1, 2023 and I signed ONE document which was the contract on November 1, 2023. 

      You created this ficticious change order because you are trying to cover the fact that you wrote a contract under a revoked LLC with a fake contractors number for an amount over what is determined by the state to require such licensure. I have every intention of filing arbitration and I will pursue criminal charges for you falsifying a document with a copied and pasted electronic signature. I have spoken with the Tennessee AG's office this morning and notified them that you are creating fake documentation and placing my signature on it.

      The BBB can close this complaint as UNRESOLVED because it is obvious you will continue to lie and won't be able to provide proof that I signed your fake change order.

      Please directly ask this contractor to provide proof that I electrnically signed this change order. This is actually getting to be quite scary that he is creating fake documents. I have contacted the ** Attorney General this morning regarding this. The complaint can be closed as unresolved since the contractor will just continue to lie.

      Please see the attached payment confirmations showing the contract price and further proving ******************* of Fine Finishes created a fake document and attached my electronic signature to it. This is referring specifically to the change order he submitted. He has created this document due to needing a contractors license in TN for contracts over 25K.  The fake document was created to bring the illusion that the contract was under 25K.

      I am rejecting this response because:
      This company is being completely and totally dishonest in its response. I have every text message/communication ever made with this company and never once were we not home when they said they were coming to work on our job. This company is known area wide for acting in the same manner with numerous other customers and I know of two who are in the process of filing complaints for the same issues. They collect the first two payments then dont care whether they ever go back to finish the job because theyve collected most of their money already.  I will provide detailed communication (all text messages) with Fine Finishes to the BBB during their open hours of operation. ******************* is in breach of contract (copy will be provided to the BBB during their hours of operation).

      this customer failed to give us access to her house on multiple occasions and knew we had 3 jobs running before she signed the contract we performed and met all our milestones payment deadlines under the contract she signed and agreed to she didnt like our timeline so she gave us a hard timeline to finish and if passed that deadline she would handle it meaning we wouldnt get paid. after advisement with our attorneys we told her we never agreed to a hard timeline due to them having so many issues with being home and not allowing us to work there per the contract state contractor should have clear access to all operating hours etc with or without the owner there in order to perform work. she didn't uphold her part and failed to allow us proper access to be able to finish etc so without messing our schedules up we gave her half days etc to finish our other clients projects up before that were started before her project and those clients didnt have a issue with leaving us a key or giving access because it was stated in the contract to do so. if this complaint isnt removed i will have no choice but to also involve BBB in our arbitration lawsuit which at this point she isnt allowed to say anything of defamation etc until the court hearings are settled. please be advised this complaint from this customer has a active lawsuit case against her for breach of contract my attorney can be contacted at ************ ********************************************************** if this complaint goes through i will have no choice but to include this into our lawsuit thanks

      There is no active lawsuit on this case. This vendor continued suggesting I contact his attorney, ********************* in ******* *********. I did make contact with the attorney and was told he had represented ******************* on a personal matter in the past but doesnt currently represent him. 
      ***** is making things up and is totally dishonest in everything he has said.  I will get text messages for proof sent to the BBB within the next few days. 
      Thank you for continuing to look into this for us as he charged us a fair amount of money for approximately 4 days work (32 hours spread out over weeks).

      Hello I will send u the judgment once its issued but our contract has a arbitration clause in it and they must by law file a arbitration dispute before a judgment is rendered we have retained our attorney to handle all the incoming letters from these 2 individuals. How can I send u all the pdf documentations showing the contract they signed with arbitration clause before a judgement can be rendered and there negligence on violating the written terms of the contract etc once those are reviewed I would ask that BBB would hold until either myself or the complainants show proof of a judgement/arbitration dispute has been confirmed and a decision  has been made cuz at this point its here say and if we lose in court which in the last 15 years this would be my 3rd case of a client not wanting to pay for work etc would be non likely a judgement would be rendered in there favor but anything can happen in court so please allow both partys time to go to arbitration and have a judgement rendered before posting these complaints to my file ** ..let me know how I can upload more then 3 files of PDFs ** I can also do a pdf zip file if that works
