      We contracted with Southside Builders in January 2020 to build our house. We had known the owner, as he was our salesman for our townhouse in Twin Creeks, so thought he had ambition to obtain his contractors license and move forward. Unfortunately, we have had multiple problems with our build coming in 100,000 plus over the estimate and a malfunctioning heating and cooling system. According to his Website "Exceptional Quality with partnership all across Greater TN, we pride ourselves in providing exceptional quality materials and labor to each of our projects."
      With that said, we were left at closing with many problems with our heating/air system installed by ******* ******* and ******* **** ******** Rd, **********, TN XXXXX. The first problem was the installation of the ductwork which was performed by 2 young adults who showed up to work in flipflops with their dog. The ductwork was jammed into the attic and crimped to obstruct flow and vents put in the wrong places. We complained and got minimal satisfaction. Then came the installation of the units in October, 2021 and ******* had one worker to perform the duties and it was obvious he did not have the skills to perform the duty. He ripped out walls to find a leak in the system, could not determine why the heating system would not ignite and other functioning problems. Calling ******* on several occasions and he always had one excuse after another on why he would not come out for the day and told us you should have no problem with heat as you have a heat pump and fireplace to keep you warm (didn't I pay for a furnace?" Due to our foamed in attic we also had an ERV system installed which was hooked up wrong and to this day still not functioning. June 2022 our mini split malfunctioned. Our builder refuses to pay ****** ***** who was called in to trouble shoot the problems after ******* could not and we are now stuck without AC. So no heat in the winter, no AC in the summer and no resolution

      In response, I would like to be clear that we signed the contract in January of 2021. In the original complaint, I mistakenly put 2020, and Southside restated the same wrong date.We signed our contract at the end of January, 2021. I need to be clear that in the original complaint I mentioned we were more than 100,000 over budget, but that was not the main issue and I did not want retribution for that, but now since he brought it up I will give a little history. At the time of signing the contract, I asked him "Can you stay on budget?" He replied he priced the build high and would stay on budget. Prices did go up and we accepted that, but the fact is that Southside grossly underestimated most of the supply quantities (rock, concrete, landscaping, insulation, paint and drywall),even though he had the lot size and building plans to reference. We also gave him a list of upgrades and didn't deviate from it.
      The main complaint is the HVAC system, which never worked correctly as stated in the main complaint. We have had problems with the main unit since we closed on the property or should I say even before the build was complete, but what brought us to submitting the complaint to the BBB was the malfunctioning of the mini split over the 4th of July holiday and getting the promised repairs from Feb/Mar completed. We were still waiting for ****** ***** to come and repair the ERV system which was initially installed by ******* HVAC when the mini split failed on June 30. Southside and ****** ***** both said it was a power surge, but ********** ********* denied, none of my other neighbors reported failures and none of our other appliances showed power failure.
      When we spoke on June 30, 2022 concerning the mini split unit, Southside said to buy a portable unit out of the 5K I was holding back. I told him we will have to see about him getting the 5K and he started cursing at me on the phone and calling me disparaging names. I was not able to finish my comment as to why I wasn't willing to pay him the 5K When the technician from ****** ***** came out that evening, he did not do a full visual inspection of the unit and stood behind a power surge, then ordered a mother board and compressor for the unit. After multiple calls to ****** ***** at the beginning of August, we found out that Southside would not honor the 1 year builders and HVAC labor warranty and we would have to pay. When we finally told ****** ***** to come out to fix the unit at our expense, they found that it was just a loose wire and wen that was attached the unit was working. They also fixed the mother board on the ERV in 15 minutes time, but we received a bill for labor.
      The main HVAC to cool a >2300 sq ft house is a two ton unit, which an efficiency study showed it was too small and will not handle the heat of the summer. That was the main reasons why we withheld the 5K in the first place, as we needed it either to replace with a larger unit or the continued maintenance for the lifetime of the unit. I am attaching a settlement proposal which we wrote when we payed him the balance of the build minus the 5K.
      Now, Southside will not honor their 1 year builders warranty and we were supposed to pay for the labor of the HVAC unit. To say we had adequate heat in the winter is a LIE. With our ventless fireplace we could hold 64 degrees and were constantly ignored on repairs by ******* HVAC. ******* constantly had excuses on to why he would not or could not come out to do the repairs. That was when we asked Southside to intervene with another HVAC company, and we chose ****** *****. Southside contracted with them to continue with the 10 year parts and 1 year labor warranty on the unit. Come the June 30th instance, we started receiving invoices for payment. We never signed anything stating we would pay the labor costs. This is a total LIE, ruining the reputation of people who always pay their bills on time, even the contractor through the build.
      In closing we are not looking for Southside to cover our overages, which he never supplied the itemized bill, just showed us an amount paid on a spreadsheet. We constantly asked him for an update on the budget, in which we received the two emails in the attachment.We had to beg him to finally give us the bills and he acted like he was doing us a favor.I am also restating the bills from ******* that showed he was paid in full for the HVAC and the settlement we asked him to sign when we settled the final build.
      Southside has to realize that the BBB is in business to protect consumers from unscrupulous business and not the reverse.
      Southside will not honor it's one year warranty. They have done inferior work. they have no control over their sub-contractors. If this continues the BBB will be receiving many more complaints.

      You told me that you were not paying me the 5k that was left. I said to keep it. So I am assuming you are complaining now that you had a 100 something dollar service charge, in exchange to keep 5k. Sounds like you are ahead. I am confused how you are upset. Also this has been the hottest summer in like 10 years. Your HVAC IS sized correctly due to your encapsulated attic. This summer would have proven the HVAC, whether it is sufficient or not. Clearly it has been. Once again this matter is closed.
